Hi

 

I am married with a US citizen since 3 years and we are inside the US - We have two children, we filed in 2021 I-130 and I-485 concurrently.

I got my biometric appointment, EAD and AP, but I-130 has been pending for 12 months now which got me suspicious: 5 years ago I was petitioned for a K1 visa by another US citizen, unfortunately after two months of filing the I-129F I asked her to withdraw the application as I we had multipel fights and I realized we are not fit for each other. The case was withdrawn before it was processed.

Years later I applied for B1/B2 visa and I got it and I was travelling always back and for to the US until I met my current wife and we got married and decided to stay in the US and apply for marriage based GC.

Can this be the reason for USCIS delay in approving my I-130?

What shall I do?

It’s unrelated. Many people who applied for AOS on 2020 and 2021 still haven’t got approved due to backlog and it depend on ur local Field office 

 

have u check ur I-485 case ? Is it outside processing time ? 
 

my i-130 just got approved a month ago after 19 months

Born in Iraq?  That could be relevant to the delay.

I think you just have to practice more patience.  The immigration process can be a long, long road.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
