Hello I was born in the USA and am a citizen. Filed for I-129f for K1 visa to bring my fiancé in iraq to the USA reference date of November 23-2021. I payed for an immigration lawyer to file the petition for me but I see that he submit the application using a birth certificate of my fiancé in Arabic. I submitted the petition with her valid passport and an untranslated birth certificate.

is this going to be an issue? I can translate the birth certificate and notarize it and send it as an additional document. Should I do that?

when I asked my lawyer he said that it’s fine and we don’t need to translate her birth certificate. I would appreciate any help!

Thank you so much, I was really worried about that, there is one other thing I’m a bit worried about and that is the passport style photos. My lawyer attached a scanned copy of the passport style photos and I went to cvs to print them out, but maybe they weren’t the right sizes. Do you think that would be an issue?

Regarding the birth certificate, since your lawyer already sent it, it is with USCIS. If they want they can send you an RFE for a translation even if a BC is not needed at all. My point is it should not have been included at all to avoid this altogether. I’d just wait for an RFE and not send anything now.

The instructions to I-129f state it has to be 2 by 2 inches.

Everything you have to send has to be translated. If u wait to get a RFE then it will take much longer to process. Safer to just send it.

Ok I’ll get it translated and send it. What about gold receipt. I bought my fiancé gold when I was in iraq and I sent a receipt in Arabic. Should I translate the receipt and send it as well?

Why do you say to not send anything right now? Do I lose anything by sending a additional document?

The biggest issues with sending additional information that was not requested via an RFE is that you run the risk of USCIS not connecting the additional information to your original submission.

I’m a USC For form I-129f I sent two documents in Arabic. My fiancé’s birth certificate and receipt of gold I purchased for our engagement like the ring. I gave these documents to my lawyer and he sent them as is in Arabic. I talked to my lawyer he said there’s no need to resend them with a translated copy. What should I do, should I translate and send the documents or should I just wait? Will my case take longer if I send more documents? My receipt date is November/23/2021

Would that be an issue? It’s better than not doing anything right?

Not necessarily.  As others have said, the intending immigrant's BC is not needed for the I129F, it is likely that USCIS will simply ignore what was sent.

Fire the lawyer

The petition clearly states  what is needed and your lawyer is incompetent

USCIS may send the packet back or send an RFE and they will send the notice to the appointed lawyer

u do not post a timeline or ID the office handling the case

if u have not yet recd a case #  how would u know where to send the needed translations

You received sufficient feedback to make your own decision as to whether or not you want to send a translation. We can’t make that decision for you.

Also not sure why keep your lawyer when he already created more problems for you rather than make the process easier. And with such basic stuff like a required list of documents… USCIS provides a list of documents they’re requesting…. It’s on their website, it’s public info. This is just very, very basic.

did u read the petition thru in its entirety before he mailed it ?

as u are responsible for all that is stated in the petition and lawyers make mistakes (big one is leaving off children of either of u and they need to be on this petition even if not traveling now to the US)
