Hi, I have a US citizen friend who recently married overseas and is looking to get a spouse visa for his immigrant wife. He is looking to file I-130 petition  but the issue is that she was not assigned a last name on her marriage certificate, ID card, or birth certificate ( don’t ask why cause I’ve been wondering the same thing). If anyone can give me clear advice on this, as I don’t want to provide him with the wrong information and delay his process. What would be the best way to approach this?

Normally for first name not assigned it's FNU. I imagine he'd put LNU (last name unknown) and put an additional sheet answering that question to explain. 

 

Did the spouse take the married name and is she getting a new passport with married name?

 

Which country are we talking about?

I doubt that.  IT makes no sense at all......Tell your friend to sign up for VJ.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

OP. can the wife change her name in her passport ? take the husband last name? it is so hard to change a name in some country and very expensive

She plans on filing with the husband's last name but as of now, none of her documents show a last name. She is from Pakistan

She plans on putting her husband's last name on the application. That's kinda what I was asking about, is that possible to do even though her Pakistani passport and marriage certificate does NOT have his last name on it next to hers?

She has to ask the rule in her country / consulat ( if she doesn’t live in Pakistan right now ) 

 

In indonesia is possible to bring the marriage certificate to put her marriage name in the additional page ( annotation ) of the passport but can’t change in the bio page ( need court order for that) but even to put annotation already so expensive and  

bureaucratic 

 

My suggestion she should start investigating now so by the time she got the interview, she already got her new passport

Typically a person with only one name would have a passport with that name as the "Surname".  In this case, there may well not be a passport yet.  She should inquire about getting a passport in her married name and determine what her full name on that passport would be.  They do not need to get the passport before filing but should definitely get the INFORMATION before filing and file in the name that WILL be on the passport.

 

That answered, it's best the person asking questions here be the petitioner or the beneficiary.  Lay folks trying to "help" often don't know what to ask and don't have the personal knowledge needed about the people they are trying to help.  If the people are not competent (for whatever reason) to do it themselves, then they would be wise to hire a professional rather than seeking assistance from a friend who knows no more about the process than they do.  That's my "opinion" and everybody is entitled to it. 😉
