Hi! My mom is an LPR who is petitioning for my dad to come here with my sister as derivative. After 29months finally the petition got approved (yay) question now is.. My mom lives with us, so will my dad and sister when they get here. With that being said, household will go up to 8. Question is; my mom does not meet the requirement for the uscis household guideline. She makes less which means I will have to be the co sponsor. My husband and I file our tax jointly, should be fine to send our tax transcript right? Also do I fill out another I-864 or does my mom and I fill out the same one?

 

please help!

The I-864P poverty guidelines in regards to your mom is for your mom & dad ONLY, total number of people in the household would only apply to you as the joint-sponsor, if they are all listed on your tax return as dependents.     Both of you would complete an I-864 **

The straightforward way is for your mom to be the primary sponsor and you and your husband to be the joint sponsor.   I-864 from your mom,  I-864 from you, and I-864a from your husband to be a household contributor to your I-864 for combined income.

So 2 of the I-864? We have no problem be co sponsor for her. Just wanted to make sure we get it done right for paperwork so we don’t run in to delays. They will just be living with us, I don’t know if that matters.

Your sibling cannot be a derivative on your parent's petition.

Most recent tax transcript only from each of you  .. for another month that is the 2020 tax return.

 

Your mom lives with you?  Then you complete the I-864A

 

Which AOS form are you submitting?

 I-864, Affidavit of Support Under Section 213A of the INA
 I-864EZ, Affidavit of Support Under Section 213A of the Act
 I-864A, Contract Between Sponsor and Household Member
 I-864W, Request for Exemption for Intending Immigrant's Affidavit of Support

Yes you need to submit the I-864A  as you are a joint sponsor and your mother is part of your household.     Your mom completes the I-864

 

Only the most recent tax transcript is required, from you and your mom.
