Visting after submitting I-407 form to abandon permanent residency

Hi all,

 

I'll just get straight to the point! I moved back to the UK last year and submitted a form to abandon my permanent residency. As a side note, I was still awaiting the removal of my conditions on my residency at the time. My question is can I use an ESTA to visit my husband in the US for a holiday this year or do I have to wait until I get some kind of confirmation for my I-407?

If you are in the  “system” still as an LPR then my understanding is your ESTA application will be denied.  Otherwise you are good to go.  Do you have evidence you filed I-407? Do you still have the green card?

Thanks for your speedy reply! I think I took a photo of my I-407 before I mailed it and might be able to find post office tracking number but otherwise, no. I actually don't have my Green Card anymore. My removal of conditions was taking a very long time so I got an extension letter and when that ran out I got a stamp in my passport as proof of residency for a year. At the time of getting the stamp, they took my expired Green Card.

It's an interesting question. You could always try the "contact USCIS and ask" route and see if they can confirm via phone that you've been removed in the system as an LPR.

Yes, it expired Jan 2022.

You can contact USCIS/CBP or since you’re in the UK if possible fly through Dublin in Ireland where they have preclearance so you have peace of mind you won’t arrive at the USA airport and face a possible removal or complications. Just a suggestion 

IMO if you do the ESTA application and you’re approved you’re good to go. Someone who voluntarily relinquished permanent resident status is low probability for having problems at port of entry.
