Since 2005, I've seen no evidence of any negative impact at any stage of the process.  If there was going to be an issue it would be at the interview, not NVC, but I've never seen that either.

Okay that is reassuring. I have had some anxiety because I am wondering why my lawyer did not request evidence for me to send in with my I-130. So I just went ahead and did it myself

Hi, 

 

Can someone help me! I am trying to file my 2021 taxes but I don't know how to do it. We are waiting on my husband's I-130 approval. He doesn't have an ITIN and I am not sure if filing as single is the right thing to do. I don't want to put our case at risk. Please advice!

To be clear.  If you are married you must file as:

 

1. Married filing separately

or

2. Married filing jointly

 

Not as:

Single or Head of Household

 

There are differences in how taxes are calculated for Married filing separately vs Single

You don't know how much your post helped me. I hope even now 2 years after your post that things remain the same on USC's side. How am I going to explain years of filing as single otherwise? :(
