Sue an undocumented immigrants

I got scammed by an undocumented immigrant of 4,000 thousand dollars. What action can I take? Can I go to small court claims? Will she be deported if I report her to I.C.E.?

Depending on the specific type of scam, you should report to the right law enforcement agency.

I got hit once, while riding a bicycle, by an illegal alien driving a car with no insurance or license, and the police told me there was little I could do about it, and I was left withe the ER/ambulance/medical bills to pay on my own. Life long chronic back issue from that too

You can file a police report and go to small claims.  Winning in small claims doesn't doesn't mean you will get your money back.  Winning in court and getting the person to pay are completely different things.

You can report her to ICE.  Expect nothing to happen.

Small claims court is a waste in general.  You will have to pay filing fee and pay a process server to serve papers, you will be looking at close to $400 just for that.

 

If you win pretty much nothing you can do get paid, so in the end small court would be a waste of time.

You can totally report fraud to the police.  I'm not saying they'll investigate, but they will take the report.   OP hasn't explained what the theft, fraud or scam was.

Police will call it a civil matter, they will not take a report. Police will tell you it's a civil matter
