My husband is applying for AOS. My brother will be our joint sponsor as I am currently unemployed due to Covid-19, and was not previously making enough to sponsor my husband on my own. Do i still need to fill out the I-864, and provide my tax returns for the last 3 years? or do I just fill out the form and not provide documentation since I will not be the sponsor

Yes, you must fill the form and as per the I-864 instructions, you should also provide a copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statement and/or evidence describing why you were not required to file; also include a copy of each and every Form 1099, Schedule, and any other evidence of reported income.

You are the primary sponsor, and you have all the same requirements as the joint sponsor.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You are always the primary sponsor....

Last year's tax return is required (or reason why you didn't need to file).  Years 2 and 3 are optional.

Thank you! If my only income for the last 6 months has been unemployment, do I need to provide documentation of the payments I have received as a substitute for the 6 months of check stubs?

If you are unemployed, your current annual income is $0....unless you have other forms of recurring income.

Well yes my annual income is $0 from earned income but I have been receiving unemployment compensation which they say to provide any 1099 forms (tax form) so  I thought they might want proof of unemployment payments

Your 1099s included as supporting evidence for your tax forms for previous years, not as supporting evidence of current annual income.....including unemployment as CURRENT annual income is problematic as it cannot be continued for the next 12 months.  I would indicate 0$ for current annual income.

I am interested in what @pushbrk says about this.

I agree.  The current income question asks about the income "you will be using to qualify...."  You will NOT be using unemployment income to qualify as sponsor.  Leave it out and rely on a joint sponsor.

Facts are cheap...knowing how to use them is precious...
