I am from India and my girlfriend is a US citizen. We met 3 times since 2019 December and spent total of 3months together.

I work for a US company and they agreed to sponsor an L1 visa for me, but the issue is that the consulates in India are closed and they are not accepting any applications at the moment. This has been the case for the past 1 year.

 

I have two questions.

 

1. If we get married and apply for CR1, while waiting for the CR1, if I get the L1 approved, will there be any issues?

2. If 1 is not possible, which route should I take? Wait for L1 or Go ahead with CR1?

The L1 is a non-immigrant visa so filling the CR1 that shows immigration intentions will obviously be trick because how can you proof not intentions to immigrate to the US if you in reality is on the process for it?

L1 is dual intent

FYI, the specific text of the DoS manual for L1 visas notes (bold added)

The beneficiary is not subject to INA 214(b) and is not required to have a residence abroad which he or she has no intention of abandoning

Yes…100% correct. Pre-COVID. 
 

The company I work for has 80,000 + employees across the globe and this summer was busy with people coming or going  (predominately incoming visa is L1)

H1B: Feb 2001 (London)

L1A:  Jan 2014 (London)

AOS: May 24th 2016 - June 20th 2017

N400: March 23rd 2020 - June 29th 2021

Passport: July 1st 2021 - August 30th 2021

Social Security: July 1st 2021 - October 5th 2021

Going to be dependent on the status of operations at the issuing embassy.
