Timeline

I received my K1 and I am now preparing to move and get married. 

We are looking at the AOS process...specifically the I-864.

The USC filed his 2020 taxes in April but still has not received anything. Therefore, no transcript is available yet. 

In this case, all he has is copies of the 1040 (3 pages), form 8888, and his W2s. 

Will this be enough to send with I-864 or will we get an RFE? Obviously we cannot submit the transcript since it's not available yet. 

Is there anything else that they would need other than what I listed above?

Packet 3 Received : 10/27/14 packet received by petitioner in USA ( beneficiary never received packet 3)

Packet 3 Sent : 11/10/13.. Had to schedule interview appointment and attach confirmation receipt to packet

Interview Date : 12/1/14                           Interview Result : Approved !

Visa Received : 12/10/14 picked up at Jacmel location

US Entry : 12/15/14 Fort Lauderdale, Florida

Apply for Social Security Card: 12/30/14 Connecticut

Marriage: 1/26/15

 

Adjustment of Status

CIS Office : Hartford                                  Filed : 3/18/15

NOA : 3/25/15                                            Biometrics : 4/15/15

Approved: 8/31/15                                     Received: 9/8/15

 

EAD

CIS Office : Hartford                                  Filed : 3/18/15

NOA : 3/25/15                                            Approved: 6/12/15

Received: 6/20/15

 

Removal of Conditions I-751

Filed: 8/14/17 at VSC                                 NOA: 8/15/17 Received 8/21 by mail

Biometrics: Dated: 8/25/17   Received 9/2/17   Appointment 9/11/17 

Approved: 10/23/18 -no interview

Yes. It's either transcript or complete tax package.

I was previously told that all the 1040 pages plus the W2s and 8888 form is not considered a 'full' package. However, thats all the USC has. 

Is there something else that he should have?

The more complicated the taxes are, the more forms they're gonna have. There are a bunch of schedules, but not everyone fill them out. So if your spouse's taxes are simple, that should be it

Thank you. That's very helpful. 

Due to Covid in 2020, he switched jobs, but literally all he has is the W2's since that was his only income. His income was low in 2020 (below the requirement) but we will also provide an employment verification letter and paystubs showing his new salary. Also, my savings and assets alone are more than 5x the requirement so hopefully that will be sufficient.

Remember that if you're including assets, you must send 12 months of bank statements.

That won't be an issue at all. There's also a significant amount in stocks but they are all liquid which I believe is what they require.

The transcripts from the IRS website only cover the 1040 section, so you will be fine with just either or.

The 1040, W-2s/1099s, and all applicable tax schedules sent to the IRS is a full package.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
