Hi guys, I just submitted all my husbands paperwork to the NVC including the police records which show no criminal record. However, this week a neighbor charged him with an "Uttering threat"  (UGH) he did not go to jail however, he does have to get his fingerprints and attend to court/get a lawyer. 

 

How is this going to affect our case given the fact that the police records that i submitted are clean (thankfully) and not just for the case but even for him to come to the USA to visit while we get our papers....

 

Any advice is appreciated..

You will need to obtain new police records.

ok thank you! lets hope for the best... i am so far out in my case that it will really suck to have it all go down the drain because of a crazy neighbor LOL

Documentarily Qualified - Meaning you submitted all required documentation, NVC reviewed your documents and are satisfied with it, and therefore will put you in line for an interview with the USEM.

Has the DS260 been submitted?  If so, I don't see a need for a new police report.  If it has not, you definitely need a new police report before interview, as he will be answering that he's been arrested.

Facts are cheap...knowing how to use them is precious...

I recommend getting updated police records ready for the interview.  At the consulate, your husband may be asked if the DS-260 information is still up-to-date or if anything needs to be corrected.  Then he will be asked to swear an oath that his statements in the application and interview are true and correct.  I would err on the side of caution and disclose the arrest to the consul officer rather than risk them only finding out when they run a background check.

This could lead to an extended AP.

we still have to deal with lawyers so that he doesn't get anything on his record....do you think i would need an immigration lawyer as well? i dont want any of this to affect our application

I doubt it.   Most people do not.   
 

As long as it is not a CIMT conviction,  you should not need one.

he got charged with an “ "Uttering threat” I dont  think he will be convicted but thats the charge.
