Hello guys, 

My wife's CR1 visa has been issued. We're yet to find an available CRBA appointment in London, since they are not doing them at the moment. I qualify to pass citizenship, have all documents and everything filled out, ready to go.

 

What are the options available here? Can my son travel on ESTA? As soon as I find an appointment, my wife and I can fly to London that week and get his CRBA taken care of. He currently has a UK passport and an active ESTA.

You can make an appointment for CRBA at the London embassy again (although very limited):

If your child can even get ESTA, he could in theory travel on it. However you won't have the possiblitly of doing a CRBA in the US. This might cause problems in his later life since he won't have a FS-240 certificate. And in theory, your son would have to leave the US after 90 days, if you are not able to prove citizenship.

 

It might be a pain in the (removed) today, but will make a lot of things easier for you and your son if you can get the CRBA. Try contacting the visa unite who you were in contact for your wife's CR1. They might be able to forward your request to the appropiate person.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

US Citizens are not eligible to enter on the VWP.

US Citizens are not eligible for visa's. Not possible even if the child was not a US Citizen.

Thanks Mark, I'll try contacting the Visa unit. I've been trying to get an emergency appointment for the longest, no luck. I have been checking the calendar every day religiously. Somehow, they all get taken up out of nowhere. I've been trying to get an appointment since August of last year.

 

The plan with ESTA was so he can come here at least for 2 months, and as soon as I see an available appointment, my wife and I can take a flight same day or whatever and go get the CRBA done.

You should contact the ACS unit, not the IV unit.  They have a contact form for emergency inquiries.

I'm guessing you did not disclose on the questionnaire that your child has claim to US citizenship at birth.  That's why the ESTA was incorrectly approved.  USCs are NOT eligible for ESTA --

 

"I am a U.S. Citizen with dual citizenship in a VWP country?

U.S. Citizens are not required to have an ESTA and are required to use their U.S. passport to travel to the U.S."

From the information you've shared, it sounds like you have a good case for an emergency CRBA + passport appointment.  I suggest you contact the ACS unit through their emergency contact form and let them know that you have not been able to get an appointment slot despite checking regularly.

Got the appointment and CRBA was approved! 3-4 weeks for CRBA + passport to be delivered. The second option was emergency passport - didn’t realize we could get an emergency passport, and then CRBA would be mailed. I thought we would have to apply for CRBA at a later time if we opted for emergency passport. Oh well. 3-4 weeks isn’t too bad either.

Hiya, we are in the same boat and looking for a CRBA at the London Embassy. We also seem to find they book up straightaway and are loaded with no warning. 

 

Do you have any advice for getting an appointment? Thanks for any help!

Hello! I requested an emergency appointment, sent them proof of travel within 5 days, and they emailed back around 8am CST on Thursday, basically saying that the appointments were about to go up in the next few minutes, which they did. They were all gone within a couple minutes! I would email them for an emergency appointment if you're traveling soon. If not, I'm sure they can guide you as to when the appointments go up.

Just FYI, we opted for the regular processing for the full validity passport, and it took about 2 weeks from interview to receiving it in mail.
