Hello-

 

We are both almost 20 and my boyfriend and I want to marry and have him stay here. I (USC) stayed with him in Canada for a few months. Then we came to Houston recently to his mom's who is a permanent resident here. He's from Canada. I understand all the forms and I will most likely require a sponsor. I work full time now in Houston, started recently $10 an hour with good tips at a high class restaurant, but my parents have always filed their income tax with me as their dependent in California. So I've never filed an income tax on my own. His mom is a permanent resident and will sponsor. I am concerned about the I 944 and I 864 because I've never filed income tax on my own and have only recently started working full time. His mom earns 65,000 a year and has about 350,000 in cash assets. My boyfriend and I have combined  27,000 US  in cash assets. He is student finishing associate's in finance.

 

Can my boyfriend and I marry and have him adjust status  and stay?

No, not uncommon, and by the time you interview you will have a years work, filed taxes for this year, in and they will no doubt want updated forms and may not need his mother.

Please note that when adjusting status the affidavit of support is submitted up front.  It's probably a good idea to submit a joint sponsor's affidavit and supporting documents too.  However, at interview, you can submit an updated one for yourself and ask that you be approved without the joint sponsor.  Perhaps by interview time you will both be working.

Thanks-So I should submit my i 864 for my future hubby, my mother in law's co sponsor i864 and Clayton needs to submit the i944 will all our info all in one shot. The i 944 seems redundant.

Your MIL is "joint sponsor".  Yes, the I-944 is redundant, and will probably be discontinued soon.  Check the specific requirements at the precise time you are filing.

Your boyfriend have two paths to stay in the US and get a green card.

 

Do you want to get marry?  Are you contemplating marriage because you think that is the only way for him to stay here and get a green card?

 

If he stays single, his LPR mother could file to adjust his status since he is 19 years old and the F2a category is current.

If you to get marry, he can adjust status through you as his USC wife and his LPR mother can be your Joint Sponsor for the I-864.  You not having filed tax returns will not be a problem with a Joint Sponsor.
