Cancelled K1 Visa After Argument... Now Filing for a Spousal Visa. Any Issues?

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Where are you getting this stuff from?

Email was hacked?  Who's going to bring that up?  The CO making that assumption?  When asked about it, the beneficiary is going to bring up hacking?


You are being ridiculous.  

Petitioner alleged fraud on the beneficiary's part, so the CO will look at it.

I got my "stuff" from my friend who was in the same situation and when he went for his second interview he was told that by the CO. but no, you " know better :)

Here is a follow up...

I confessed to the uscis the letter was done in anger...I believe the sooner you say the truth the better (less then a month) 

now I did not date the letter,notarize it or send my ID. 
I will follow up on Monday - Tuesday when they call me back.

Thank you...a lot of sleepless nights and anxiety due to this.

 

I don’t know if my visa is now invalid or what step to do next...just waiting till the officer calls me which is terrifying but it’s a huge lesson!

Further update :

would it be worth waiting for the Uscis officer to call me back Monday-Tuesday confess and ask for them to invalidate the letter 

or should I just accept that since I sent it after an approval to the uscis that I cancelled the petition regardless? 
we haven’t started NVC and now I’m just trying to figure out if I got to plan a wedding within 3 weeks at his country.

They won't 'invalidate' the withdrawal.  Similar cases here have resulted in the cancellation of the petition, and the allegation of fraud adds yet another layer.

Do I just refile for a k-1 or do spousal I guess is the question as I am only confusing myself more at this point sorry 😅

I think you do not understand the difference between a petition and a visa.

I gave you advice earlier in the thread:  if it were me, I would spend more time together in person before trying to petition anyone.  Marriage is a lifetime commitment, and when you throw US immigration into the mix, it is an even greater financial commitment.  Cancelling petitions on a whim due to an argument makes it pretty clear that you need to get to know each other better before proceeding.

Hello everyone,

on January 7th I spoke to a tier two officer she gave me assurance that my petition since approved after my withdrawal letter was sent to USCIS that it would most likely be ignored. 
however, I decided to check my case status today and I got the worse notification ever they did withdrawal my petition. 
now I know a withdrawal cannot be reversed at this point sadly. What other options do I have? 
also is there a way to get a birth certificate from USA when abroad?
