Trump says 'hopefully' states won't be allowed to count ballots after Election Day, which is a normal part of the electoral process

if your tax return is postmarked later than the last filing day does the IRS still count it as filing on time ?

  Bad analogy. He wasn't talking about postmarks, he was talking about not counting votes after Nov 3rd. We know that it usually does take longer. We have actually seen that happen to various degrees on many occasions, the 2000 election probably being the most significant example. If you remember back to 2000, federal law allows states up until 6 days before the electoral college convenes to complete the process of determining who the electors will be. That includes vote counts, recounts and any legal challenges to the outcome.

I have never had the IRS reject my return or check, even when late.

If a ballot is valid, and the postmark is valid, why would it be thrown out?

Because you still have to cure it. If the ballot is rejected then it has to be sent back to that person for them to cure or fix their ballot then send it back. Which the main reason the absentee ballots get rejected here in NC is that they aren't getting a witness to verify it before they send it in

You would need to fix a ballot that was wrong, but not a perfect ballot with a postmark of election day.

   Why shouldn't states be allowed to set their own criteria? The constitution allows that, as long as the meet the obligations set forth by congress.

States should which is why we don't need the Congress passing election laws.  But the questions being asked is are states following their own constitutions when making these changes.  I heard in one case the states will not be allowed to verify signatures when this has been part of their election law regarding absentee ballots.  This is something that has been being pushed by the Democrats in several states including my own.

    Specific to the OP and topic though, why should any state stop counting votes at midnight on Nov 3rd? They should count any legally cast votes until they have finished counting them all, up until the deadlines set forth by law or constitution. That's how every other election has worked.

What I don't get is the belief that the voter   edit: exists to comply with the rules instead of the rules and systems serving the needs of the electorate. If the state cannot understand that concept it is time to retire some officials. 

 

If the mail is postmarked, the deadline is not the evening of the postmark as the president has tried to claim.

    Most of the changes here have been in response to the ongoing pandemic. It seems like most of the resistance is coming from the same group(s) that are opposed to making any changes because of that. The president included in that group.
