My wife is currently on unemployment due to the pandemic, and is currently in Brazil for a family emergency. She tried to begin the process to claim her unemployment benefits online and our state's department of labor flagged it and she may get penalized, as if you're unemployed, you're not supposed to try and claim benefits from out of the country. For what it's worth, she was in the country for part of last week and is entitled to partial week benefits. Long story short, it's possible she will lose a week or two of unemployment benefits as well as the possibility of a small fine from the department of labor. .

 

Question 20 on the I-751 form states:

 

"Have you ever been arrested, detained, charged indicted, fined, or imprisoned for breaking or violating any law or ordinance (excluding traffic regulations), or committed any crime which you were not arrested in the United States or abroad?" There are then check boxes for yes and no.

 

My wife has never committed a crime or anything of the like. If she even gets fined for this, would we need to disclose it? It seems like question 20 is talking about criminal matters only, including being fined for a crime. I've done the research and if she does get a fine from the department of labor, this is NOT a criminal or even civil matter. It's basically a penalty you pay to the department of labor for negligence, and the dispute exists between the unemployment claimant and the department of labor only.

Hi, I beleive that section on the form refers to crimes.. you can not qualify for unemployment in most states unless ur are actively looking for and available to work..she can claim any week in which she was available to work for the entire week..therefore she is not eligible for any week where she was not in the country.. if she filed a fraudulent unemployment claim and received money she's not entitled to then it could or would or might be considered a crime depending on your state..However, if she filed  only truthful Information or made a mistake and was denied then there is no crime. I would think you're ok NOT to include this on your form.   Arrested, charged,and fined are official proceedings . If she has not officially been charged or arrested or ajudicated a fine at the time u file then I personally would not list it on the form. If she received monies she was not eligible for you should repay that ammount right away to avoid reclamation procedures by the state.. I hope this is helpful.

Sent our packet Oct. 07 and delivered Oct. 09.  Payment is still not cashed yet.  One thing we need to keep in mind is that, all federal employees' unused leave will not be allowed to carry over more than 240 hrs to next year even though people couldn't go anywhere during COVID.  That means there might be more delays before the end of year as many employees will take leave.

I have unintentionally become an October filer. I originally submitted everything 9/21/2020, it arrived on 9/24/2020, but was returned on 10/8/2020. I had filled out the form awhile ago, but before mailing only checked the top right corner which had all the same numbers and showed expires 12/31/19. They returned the package to me on 10/5/2020 because the bottom left corner was for a different date than the current. My bad for not checking the forum more carefully and assuming the important numbers were at the top. It did include a special paper they told me to include on top when filing again which I guess signals to them I've already attempted it once. It wasn't clear if they wanted me to also send everything back as is and just replace the outdated form or not. I ended up reprinting everything because of the pages got torn and had holes in them because it looked like someone when at it with an industrial strength stapler before sending it back.

 

I updated both spreadsheets floating around but my package arrived on 10/9/2020 and they still haven't cashed my check as of today.

Do you mind elaborating? So the top right details were the same, but the bottom left details (the edition date, which is currently 12/02/19) wasn't the same as on the website?

Right, the form I submitted was identical to the the current form if you only looked at the top numbers (OMB No. 1615-0038, Expires 12/31/2019), but the edition date in the bottom left corners was for a 2017 date because I filled it out back in 2018 after getting the conditional green card. I was going to download the form and copy them over but saw the numbers in the top right were the same so figured it hadn't been updated. Lesson learned.

Not yet and I hope that doesn't become an issue. I somehow dismissed and therefore missed my calendar reminder back in August so we are filing a bit later than intended. The current card doesn't expire until 11/5/2020 so there'd still be some time to try once more (though still less than I'd like) if absolutely needed to submit again if they flat out reject it. Hopefully they just accept it and everything goes smoothly or at the very least get an RFE for something as that's at least timestamped in the system within the 90 day window.

Sent our packet today. They were "OUT" of flat rate legal envelopes at my USPS..had to use the $26 envelope which when I got to counter was actually 48$ OMG..How is the post office out of their own envelopes? I'm so stressed about having enough evidence I didn't wanna not mail it..so like a sucker paid the 48.90 for 24hr delivery..smh! out of envelopes......SMH!
