Hi all,

So I was documentarily qualified at the NVC this morning for my husband's CR-1 visa. I am living & working abroad so we used a joint sponsor who has taxes for the last 3 years showing more than 4 times the necessary income. He's self employed so we provided bank account statements and a letter from him on his business letterhead certifying his employment. Due to IRS delays we submitted tax returns not transcript for both myself and our joint sponsor for 2019 but tax transcripts for 2018 and 2017. My joint sponsors affidavit didn't include any household member income or assets as it didn't seem necessary with his high income.

 

Does anyone know if the lack of transcripts could be the reason for not "meeting the minimum income requirements" or do I really need to start looking for another joint sponsor...Any advice is appreciated. Thanks.

If you got DQ this morning it would indicate y’all have met the requirements or they wouldn’t DQ you....

Yes, this is why I was confused. Sorry for not explaining well I am freaking out a bit: I got DQed AND a message in CEAC saying that "[my name] and [my joint sponsor's name] does not meet the minimum requirements" but I don't understand how this could be becuase as I mentioned he is making upwards of 4x the poverty guidelines

The typo with "does" is from the NVC itself.

you need to have the joint sponsor fill out the Number of family members (all that will be included even you as your income if your income is not to continue when coming to the USA / that is the only way NVC can tell if the income is enough

On the I-864 I included the # of family members as him, his wife, and my husband (the intending immigrant) so I counted it as 3. So you're saying that I needed to have included myself in this number and that's why they aren't accepting it? I am not a dependent of his so I figured that I didn't need to include myself in his household calculation, but if I understand correctly you're saying that since my income won't continue I would count as a part of his household?

Additionally, I understand from the language in the "NVC Feedback" that they sent, which I will paste below, that they want me to add another joint sponsor. I was under the impression that I can only use one joint sponsor...is this wrong?

 

Here's the text:

 

"[my name] and [joint sponsor's name] does not meet the minimum income requirement to sponsor the intending immigrants for this case. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p. To avoid delays, an additional Affidavit of Support Form I-864 for a joint sponsor may be submitted. FINANCIAL SPONSORSHIP RESPONSIBILITIES: Financial sponsors, joint sponsors, and applicants should be aware of responsibilities when signing an I-864 and the consequences for a sponsored immigrant's acceptance of federal means-tested public benefits. For more information visit https://nvc.state.gov/aos."

NCV is recommending another joint sponsor.  The decision will ultimately be up to the officer at the visa interview.  You can have more than one joint sponsor.  If you go to the interview without another joint sponsor, and everything else looks good, worst case scenario is they will ask for another joint sponsor and give you time to submit the required documents before they make a decision.  If you can take the 2019 IRS tax transcripts to the interview it may be enough to get approved, but to be safe, also take another I-864 and supporting financial documents from a new joint sponsor that you can present if asked, to avoid any delays in a decision.  Good luck!

Looks to me like you may have used the wrong number from the latest tax return when stating the income of your joint sponsor.  It is the line labeled "total income".  Self employed is a different animal.  Business revenue is different from what is considered "income".

 

You say there was no Tax Return Transcript for 2019, but there should have been a tax return.  What's the number on line 7b of the 2019 return?

Thanks for your response PushBrk I am so glad to see you here!!! Yes, we sent in the 2019 return, line 7b is: $115,931 which is exactly what I put as the answer to question 24.a. (total income for the most recent tax year) on the affidavit. I also used the "total income" line from the transcripts for the two previous years (both years were similar to the figure for 2019)

Now I may have answered "Current Income" incorrectly as i did not use that same number (I used one slightly larger based on income to date for 2020) so maybe that caused a problem?

Yes, that could be the problem.  A self employed person's current income is the total income number from their latest Federal Tax Return.  It is not income until it appears on a tax return.  (For Self Employed)  Prior to the tax return, it is only revenue.  Expenses have not bee deducted yet.

Oof ok thank you. Do you know how I could correct this? Maybe I need to upload a revised affidavit or contact the NVC

True, slef employment is confusing an example is one doing rideshare as full time job,  his total revenue is 100,000 , however after deducting all business expenses and tax relief,  the net income or taxable income might be something like 20,000. ( just an example)
