Case outside normal processing time - Nebraska

Hi everyone,

 

our I-130 (USC filed for spouse) has been sitting at Nebraska for 17 months, filed January 2019. We submitted an outside of processing time inquiry over a month ago and received an email that says to keep waiting indefinitely and that NSC process cases in order received (complete BS). 
 

we have also contacted the ombudsman’s office, still waiting for their response. Reached out to the congressman, they received a response from USCIS that our case hasn’t even been assigned to an officer yet! Got the same information from a tier 2 officer when we called USCIS. They submitted another inquiry on our behalf. 
 

needless to say, we have almost lost all hope. Does anyone know what else we can do to get a decision on this petition? Or at least to get the petition assigned? Would greatly appreciate any advice. Feel like we are being treated extremely unfairly and don’t understand why.

I think cases are generally processed in order........but 17 months is a long, long time...too long...even for Nebraska.  I'm surprised they didn't transfer your case to another USCIS SC.......was there something special about your case?  RFEs??

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

No RFEs, not even assigned to an officer. My husband is convinced someone is doing this on purpose because of race. Or maybe they lost our file. Don’t know how we can get any information.

Your file might have been misplaced.......I have no idea why anyone would think that this is somehow a race issue....SMH.

It happens pretty often. Especially with his race and my nationality you never know. Anyways, appreciate your responses.

No evidence that you have shared points to it being a racial matter. 

 

Perhaps try reaching out through your congressman a second time? How long ago was thr first contact?

Timeline

Nebraska service center has been slow.  Just wait...it will get there.  I think it took ours around 20 months. I had 1 RFI which was taken care of quickly by USCIS.

You can check and track immigration timelines from your country to pass the time.  Also,  it will give you an idea if its just your paperwork or if its happening to others from your country as well.

Your husband is from American and you are from Russia? What kind of racial discrimination does he think USCIS is committing? He can have that opinion, but without any facts or evidence to back up his claim, it's obvious that someone needs to change their thinking. Does he know how many inter-racial marriages are approved every year?  I am Caucasian and my wife is Asian. Approved in 5 months.

Fair enough. I do see race is on the petition.

Please have your husband reach out to his congressman again as your wait time is incredibly long and you most likely won't get anywhere with a Tier 2 Rep.

I understand your husband thinks its a race issue but please don't focus on that; id say k1s & CR1s are 50/50 interracial relationships. I know we are.

Same here......Caucasian and Asian........no issues......I have seen no evidence to suggest a single case would be singled out from millions of others based on race.

Yeah we reached out to the congressman’s office and they just told us the case hasn’t been assigned and that’s it. Reached out again to see if they can help push it further along.

Hi,

 

I think the problem is your paperwork got lost in someone's pile.  You stated that an officer was not even assigned to look at it.  In order for them to see the race of the petitioner and the nationality of the beneficiary, someone would have had to look at the paperwork.  At that point, they are in middle of processing, and it is easier to continue than to stop half way and move on.   Things that would halt processing is missing information (RFE, but you didn't receive any), background checks or some other verification from a 3rd party.

 

Hopefully it will be or is in middle of processing.  I would suggest you keep following up regularly with USCIS.
