Hi all,

 

My wife has her AP/EAD card and I was wondering how to lawfully babysit. Her GC interview was postponed last month and I was hoping to ask then, but I’ll ask you guys in the meantime. She wants to work, but we both want to do this entire process by the books as we have from the start. Jobs are obviously hard to come by now however she was offered to take care of a family’s children for the summer. Is this something she can accept? We would be logging her income for tax purposes but I’m not sure how it can legally be considered “work”.

Of course its work. She will be being paid for her time.

In a pure labor sense yes, but it would be cash and no formal recognition of employment. How can I make sure this type of work maintains lawful?

What your wife has now otherwise called combo card allows her to legally take up any kind of employment and earn money

well that is sole proprietorship.. if she wants to report income, IRS would certainly welcome it.

It's called a schedule C to Form 1040

If she's making more than $1,800 in one year, she needs to be acknowledged as an employee or contractor and have taxes withheld for it to be "lawful".

You do know that EAD is a work permit, yes?

This has nothing to do with her immigration status.  It is an IRS thing.

I do know that. I just didn’t know how jobs paying strictly in cash, no W2 forms etc, are treated.

She can be considered as “self-employed” or “independent contractor”... These people will use form 1099 to declare tax at year end.

Maybe schedule a meeting with tax advisor and ask how should she bill/write a receipt/charging fees for the customer/family she’ll babysit.

I would imagine this wouldn’t be too hard, good luck! :)

She may or may not receive a 1099, she will use schedule C to report the income  earned
