09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Even so. Worse they can do is send him back. But he has a chance of getting in.

If he applies for SB-1 and is denied, he has no other chance.

You’ve made a grave miscalculation my friend.  
 

Your obtained your green card through your father who is now in the Philippines?  You are not eligible for an immigrant visa therefore not eligible for an SB1.

 

Your case in my view is DOA and that’s from standing at the interview counter fully and completely prepared to file a new I-130.  To apply you submit your green card.  I think that would be the last time you see it.

Quick question how many or is there an Immigration lawyer here?  Just for curiosity, How man of you based your opinions on personal experiences? or majority if not, all of those who gave their comments were just basing it on their own personal belief? Now don't take in a wrong way, I'm just curious.

I sent you an item by item blog.  Read it.

 

My opinion is based on personal experience.  I filled out every form, attended both of my wife’s interviews.

 

You sent a note to me saying you already qualify however I do not believe you do and I do not believe you have an approved DS-117 or you would not have a green card in your posession right now.

 

When you file a DS-117 you have to submit your green card.  You do not see it again until you enter the US, activate your SB1, and they open your envelope and return it to you.

 

I would appreciate it if you do not mislead us here, thanks.

@Nitas_man I am not misleading you. As per legal advise I am qualified. but to get approved that is a different subject. The term that I used was exactly the term that the legal counsel told me.  Now, when is I say Legal Counsel doesn't mean we already have a contract. We don't, but I am sure you heard the term Free Consultation. So I asked  to these lawyers about  other people's personal exp and they said these. " Just because it happened to Peter, doesn't mean it will happened to Paul " It still based on how the Immigration officers. Based on their moods etc.

@geowrian You said that you have to disagree that This situation is not unique with PH comapared to many other areas.  Well, Unless you are very familiar about the Philippine system then I would go on your opinion as far as disagreeing with me. You said PH is not unique comapred from other areas?  Try to come here and lived for more than 1 yr to justified that. Otherwise it will be just an opinion based on belief and not as fact. In any rate I respect that. For the taxes though, How am I going  to file? I don't have a properties so how can I file? I already filed my taxes back in 2016 before I left.  So what kind of taxes am I going to file if I don't have a property? specific on the taxes we have diff kinds of taxes

@Boiler I did worked in the US but what I worked for I already filed. 2017 I no longer work in the US cause I am no longer there. In terms of working in this country. As one of the layers stated, there is nuthing wrong it because I need to support myself. Unless the idea is to be a leech from someone like my father receiving his retirement is acceptable ethically then supporting your self to survive has nuthing to do with it. Did you tell the Lawyers that you had been working and not filing a US tax return as is required of US Permanent Residents?

You are missing the point of those who have raised the issue of working overseas 

1.  A legal obligation of maintaining your LPR status is to file tax returns that include all income .. earned or unearned... from worldwide sources not just from in the US. You have

not done this even though you have earned income while overseas 

2. Taking up employment while out of the US is often seen as a strong  indicator of abandoning your LPR status.
