Can't leave the Philippines due to Shut Down

Timeline

For those that have K1 Visa approvals in the Philippines and have not left yet: What are your plans?

 

If the shut down continues for a few more  months, my fiancee K1 visa will expire. Can we ask the US Embassy to extend the visa due to the corona virus? Do we reapply and start the process again?

 

Just wondering what  options we have. Thanks in advance for any replies and stay safe.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Embassy can reissue the visa .. they have that power.   They may ask for a new medical.   This is a first for this situation so it's hard to say how it will all go when things start moving again.

Per the FAM and INA, they cannot extend the visa but they can re-issue it. A new medical would be required as the validity period of the visa is constrained by that of the medical. A new visa fee is required as well.

 

Changes to the FAM/policies are possible given the circumstances, but don't expect it. Unless such changes are announced, assume the existing policies will prevail.

I'm okay with another medical exam and it would be great if they re-issue it. It is what it is.

 

I guess I'll just wait and see what happens.

 

Would I have to contact the US Embassy in Manila?

Wait until the world situation improves, but yes you would need to contact them

Timeline

If you have your visa you can still leave. If you are outside of Manila you can get past checkpoints by showing your boarding pass. Lockdwon was extended to April 30. Check on the Bureau of Immigration website for more info.

Where in the Philippines is she from? You can still leave out of Davao and CRK as far as I know.

No commercial flights currently out of Clark since April 3 and I believe the same for Davao

When is the visa expire? I know asiana airlines still operating at manila but it’s not a direct flight to States. She will have a couple of hours of lay over in Seoul. Hope everything will be okay to wife.

Thank you and it's my fiancee in Cebu. At this point, her coming now makes little sense as we cannot get marry in the USA due to local government shut down.

Even if you could,  you can't get her off the island.  Marriage licenses will be available long before flights become available 

 

Minnesota expects to have a license solution shortly,  I expect other states are doing the same

Davao is on lock down, no flights in or out until April 30th, same with Cebu, even though Cebu appears to have the virus well under control.

Check Korean airlines. They fly out of Cebu straight to Seoul and then to US. (no stop in Manila) There might be a 14 day isolation requirement, but I'm not sure. Seoul airport has facial scanners working that record temps of passengers through the airport. As long as she is not sick there shouldn't be an issue.

No current flights in or out of cebu at the moment
