I-693 without medical exam in Orlando?

Okay, so my wife is in the process of applying for her AOS. Her K1 expires January 30, so it is crunch time (we would certainly like to avoid the $1000 fee). I have been guiding her through the steps of this process ever since I filed a petition for her over a year ago. It's gone pretty smoothly overall. She got her K1, moved here in November. We got married a week later. We're working on getting the AOS app in. But I keep running into a wall on one form: the I-693.

 

Everything I have read tells me that, since she had the medical exam with the panel physician in Ecuador, we don't need a medical exam. But as I call civil surgeon offices here in Orlando, it seems like no one is willing to sign off on the I-693 without also administering the blood tests and things which she has ALREADY received! She has the sealed envelope from the panel physician. But she doesn't have an unsealed copy. So do we just need to go to the civil surgeon office (or make an appointment) and hand them what we have and hope for the best? If we don't need the medical exam (particularly if we can get out for less money, since one income living is difficult in this town) I would like to avoid it. Any ideas or anyone know of a doctor we can turn to in this neck of the woods?

So she still has the sealed envelope? I thought that the envelope has to be handed over at the POE...

Does she have a DS-3025?

No need for a new medical if it was done less than 1 year before filling for AOS. The doctor that did it in my country gave me an envelope with a copy of the results to send with my AOS, is that the envelope you’re talking about ?

You know we don't need it. I know we don't need it. It's the doctor's offices I am trying to convince. She apparently did not get a copy of the results. And in fact the panel physician said or implied that they could not give it to her.

Timeline

Just to be clear and precise, the expiration date on her K-1 visa is irrelevant.  It was voided when she entered the US as it is a single entry visa.  However, her I-94 expires 90 after entry to the US.......good luck.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Fair point. Sorry for the confusion. Yes, her I-94 expires January 30.

If she still has the sealed envelope, send that with her AOS application. If she has the completed DS-3025, send that.

 

She does not need a new medical, and you don't need a civil surgeon to sign off on anything.

 

If she handed the envelope over at the POE, the information will be in her file already. You can include in your cover letter that her medical was already completed overseas. 

 

I would not try to get another medical done, or get another I-693 without being specifically told to do so. Worst thing that can happen is that they will request a new medical at the interview (but they shouldn't), and then you can take care of it.

Sorry for the confusion. We’re not getting another I-693. We haven’t filed it yet. We are filing it with the AOS.

The fee to allow you file an AOS after your I-94 has expired. You have to file a separate form, and the filing fee for it is $1000.

Do you mean an I-130?  If I am not mistaken, it is only required if you married later than 90 days after entering on a K-1.

Maybe. I was thinking it was if you didn’t file the I-485 before the 90 days but I could be wrong on that count.

As long as you marry within the 90 days you only have the i485 fee to pay

Read page 12 of the I-485 instructions and page 8 of the I-693 instructions. She does not need to submit an I-693, because she completed her medical overseas and is filing within a year after that medical. 

Go through her paperwork; she should have a completed DS-3025 that she has to submit in lieu of the I-693. Even if she doesn't have any proof of her overseas medical, do not get a new I-693 now, because it will have a limited validity and you may end up having to get another one if it takes a long time before she has her interview.
