I requested expedite for my EAD on November 6th based on severe financial loss, I gave the reasoning that I have credit card bills and rent to pay and it's difficult to do so without a job, I heard back today and they are requesting me to fax a pending job offer. I don't have a pending job offer, what should I do?  Should I not send anything and wait for it to get approved as per the normal processing or should I send my credit card bills and rent receipts and a cover letter explaining that I can get a job once I get EAD? Any advice is welcome!

Credit card bills and rent are a normal part of life and USCIS will not expedite for those reasons.

Agreed credit card or any other bill shouldn't be a reason to expedite. So what should I do now? How should I respond to USCIS? I never said I had a job offer. 

 

Will this also delay regular processing of my EAD?

You do not qualify for an expedite.  Just let it be processed with all the other people in the queue, who also have bills, rent, expenses etc.

Yes I understand, there is no need to be Judgemental, I'm not trying to get ahead of anyone, all I'm asking is if I should respond to USCIS with anything or just ignore their request?

Sounds exactly like you're trying to jump the queue, actually.  Yes, waiting your turn is hard, but we have all had to do it. 

 

What do you think you should do, since you do not have the document they are requesting?

I think I should either respond telling them that I do not have a job offer, or not respond at all? Which is my question.

If you don’t have an immediate job offer then you have no reason to expedite. 

 

Your spouse brought you here and she need to pay for your expenses. That was part of the deal bringing someone to the US.

 

Proof should have been submitted with the request.

All expedite requests claiming severe financial loss, regardless of the immigration benefit sought and regardless of whether the claimed loss is to a company or a person, must be documented to establish the loss and that the requestor is not able to withstand the temporary financial loss that is the natural result of normal processing times

Just respond with what all documents/details you have.. Let the USCIS take a call whether your case can be expedited or not. Also, I believe that if the case is not expedited it goes back to the regular processing timelines.

 

When did you apply for AoS and EAD?

I applied for AOS and EAD on June 29, 2019.

 

I just want the case to go back to regular processing timelines, and to do that I'm debating whether I should respond with whatever I have or not respond at all?

You can do either or. It sounds like if you don't have a job offer they are going to deny the expedite request anyway. If you don't reply, the request will simply die out. Whatever you chose it or not, it is not going to affect your EAD case or slow it down.

 

I don't think people are being judgement. It is that we see, way too many times, people who chose the K1 and completely ignore the bad things about the K1... like not being able to work or leave the country for months. Then when things get rough they sometimes complain or try things like expediting. This is one of the things that make the K1 visa suck and not worth it. Things like bills and debt can mount up while you are waiting to start to make a living.
