Timeline

Hello

Just question regarding filling up the K1 visa form 

About the current job my fiance is retires since 2013 what should we put on the job as he was retired 6yrs ago

Plus about the tax turns? He doesnt pay taxes as he is retired army

Your recent posts suggest that you haven’t even met yet. He cannot file the I-129F until you have met. 

 

Also, he is the one to complete and file the I-129F, not you. If he is retired and not working then he writes “retired” for current employment.

 

Unless his only income is SSI or he is below the federal filing threshold (which I doubt) then he is still required to file a tax return. However, the I-134 and tax returns are not needed until the I-129F has been approved and the case has been passed to the embassy. You are a long way from that if you still haven’t met yet. 

 

Slow down. Meet first. Get to know him. Then he can think about filing. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Being "retired Army" does not eliminate the need to file taxes.....unless his pay his tax exempt or his income is too low.  I am retired Air Force, and I pay and file taxes EVERY year.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Payments you receive as a member of a military service generally are taxed as wages except for retirement pay, which is taxed as a pension. If your retirement pay is based on age or length of service, it is taxable and must be included in your income as a pension on lines 16a and 16b of Form 1040 or on lines 12a and 12b of Form 1040A. Do not include in your income the amount of any reduction in retirement or retainer pay to provide survivor annuity for your spouse or children under the Retired Serviceman’s Family Protection Plan or the Survivor Benefit Plan. For additional information, see Publication 525

 

SS is taxed according to a scale determined when filing the tax returns

 

If when he retired ,  he did not owe taxes (and income would remain the same in the future)  he could send form for 4506-t  

pay attention to # 7 which is a request for non filing vertification.  IRS sends a letter that states you no longer need to file which is only for those  whose retirement and (scaled )  SSA payments (hopefully not taxable) qualify him as getting all withheld federal taxes refunded or none due.

this is the form H&R Block sent  in for my mom when she no longer had to file and they filled out the new W4 so the pension did not withhold federal taxes from her check.

I hope that is not what he told you about paying taxes, because that would be a red flag for you from jump street. I'm retired Army too, although it would be nice not to have to pay taxes cause I was retired,  but that's hardly the case and TOTALLY false.

Citizenship Complete!

Timeline

Bring him go eat chilli crab in Singapore or Or Lua or Fied Kuay Diao.    Now, if he is telling you no taxes, its a red flag, I suggest you ask him log in to Social Security administration website and pull out his history and show it to you.   IRS can provide tax transcripts too on the website ... pdf download.    Please verify what he told you, its for your good down the road so as to fix problems early.

If he’s not being honest with you about his finances, one wonders what else he is not being honest about.

Got it clarified with him 

His not paying taxes bec his pay is disability pay not retirement.

 

We are still wondering what papers to provide on our application.

 

I hope someone can clarify with our confusion

Are you just starting and filing the I-129F?  If yes, no financial information is needed for the petition process.

 

For the visa application process at the embassy -   He will need to print out a Benefits statement, plus include a letter stating why he is not paying taxes (... disability is not taxable )

Yes we are just starting and planning to submit next month until we complete our paper.

we are worries that the employment part will be empty..thats why he wanted to include that on the kit that we will submit.

 

Does this mean that income thing we need to provide when i have my case number? Or when they have accepted our application?

You would list employment history, but there is nothing asked regarding income for the I-129F.    Income information is not until AFTER the I-129F petition is approved, the embassy will want Financial Support evidence.

I understand however on the form its says job for the last 5 yrs.

Instructions for the I-129F state to put N/A, unless directed otherwise if a question is not applicable
