Are your kids US citizens? If yes, they don't need a visa. If not, look into getting them citizenship via Consular Reports of Birth Abroad (CRBA).

 

As far as I know as a US citizen, you can pass the citizenship along to the kids if you are their biological father.

He is a US citizen by birth. He only lived here for about 2 years and this was over 35 years ago. He since then lived in Germany.

 

He is the father of two children, one is 3 the other one is 5 years old. He is trying to figure out what other options he has to bring them over here besides filing the I-130 as he is filing this for his German wife.

 

The kids have never been to the US.

I am a us citizen from birth, 

But the last time I lift in the US was as u were a child and yes they are my biological kids are they still getting the US citizenship

Based on what the person posted above, your children are not eligible for US citizenship through you, as it seems you do not meet the residency requirements.

Do you may know witsh tax return form I need wane I file for the I 130 and I need to do the tax return overseas for the last 3 years

No tax returns are needed with the I130. That will be around a year later at NVC, when you submit your I864 online. Only 1 year of the most previous year of tax transcripts is required, 3 years is optional. You’ll need to amend your taxes with IRS if you haven’t been filing your taxes to the US while living abroad, though

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!
