If you make money from Japan by investment that does not count.   If you make money from employment, even from Japan, that is Employment.   USCIS forms are to be interpreted literally.     The only thing you can do while in the US is volunteering and even that has some conditions.  You can't even babysit.

I’m not employed but not good? A lot of people from other country do that because people had own business in their country.

No!  If your package in postmarked on or before Oct 14 you use the old rules and forms.   If you file after that you follow the new rules and forms.   You can't just look at.  You have to understand the totality of your family's lack doing this correctly so far.

 

Filing on or after Oct 15th means you may experience a denial due to higher public charge computations based on your previous posts.

 

It is urgent that you file a full and complete package that will be approved this time prior to the new rules.

What is your plan B if his brother says no?  You said they don't get along---so he may say no just out of spite.

Always have a plan B for everything just in case.

I would ask my relatives but would break of relationship with them before borrowing money.

Again, then you need to think of a plan B.  Is there any savings you can tap into?  Credit card?

I'm sure USCIS isn't going to have any issue with her brother-in-law loaning the brother $111,000 so they can file using assets.

$111,000?  I'm talking about the OP saying her husband's brother may not loan them the fees to refile the AOS, etc.  

If they can't get the brother to loan them the money, it's gonna have to come from somewhere else.  Haven't seen the OP mention any assets yet.

We ask to borrow money like $2,000-$2500 for refile AoS fory son and me.

I thought you husband was borrowing money to try to file as assets vs income since he does not make enough to file an I-864 without a joint sponsor.

No, his brother was co-sponsor for K1. My husband income meats 125% poverty line now.

They are trying to borrow money to refile the AOS...from what I understand during the course of this thread, the husband's salary is enough now to support the household....but don't have money at this point to set aside for filing fees.  Or something like that.
