Hi Everyone, I have a question, my mom is a US Resident and she is a petioner for my sister who was born in Mexico but she's living here in the US.

My mom didn't use a lawyer service, and we wanted to know how long does it take for her to become a resident.

Please help

A little more info is needed here to properly advise you...

On what type of visa did the sister enter the US?

Is the sister an adult or a minor?

How long has she been "living" in the US?

It’s critical to know what status your sister is on. If she is over 18 and she has overstayed/not on legal status, she may have problems. If she is on a student etc visa, then it’s ok.

the “how long it takes” question depends on whether she’s over or under 21.

Wonder what the plan is.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

If the child is under 21 the priority date is now current. If the child is over 21 there is a more than 20 year wait for a visa. Either way the child must have entered the US with inspection and be in status.

I hadn’t realized the F2B wait for Mexico was so long, but this is correct. Almost no way she’ll be in status if F2B.

Hi, she entered with a tourist visa, she is a minor (11 years old) and she has 3 years living here in the US, her visa expired a year ago. My mom send the paper work (form I-130 and the one for adjustment of status but that one got sent back because there was a waiting list) almost 18 months ago.

Thank you

She can not adjust status, she is in the US illegally.

She is under 21 (11 years old) she entered with a tourist visa but has expired over a year, my mom sent the paperwork over 18 months ago

Well it is not now.

18 months, presumably the OP filed for her Mother 3 years ago.  Mother got her GC and filed for daughter.

As you know but the OP seems not to, you need to be in status to adjust status, exception for immediate relatives of a USC.
