August 2, 2018 Case Complete At Consulate

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I’m not understanding very well apparently. The original post talked about B2 then repeated ESTA entries and now we are on to employment based green cards. Who is going to file for her as a sponsor?

I feel like some people didnt fully read my opening post...

 

Companies only sponsor bachelor degree candidates for jobs on the HB1 visa right...and it's taking them 3 years to get through those.

 

It's not allowing to attach the file because it's too big. 

 

And noone can file to be her sponsor...

She most likely needs to work on her education to avail all but J series.

H1b?

 

Not an obvious choice for an Au Pair and no they do not take 3 years, there is a annual Cap limit but exceptions for non profits etc.

H-1B requirements are pretty strict. A bachelor's degree and being in certain areas are the key elements.

Although the biggest hurdle is the I-129 petition (handled by the company), which is not much more more than 15 days (once filed) with expedited processing, although LCA and such can take longer. But we're still talking weeks and months, not years.

Getting selected for H-1B is the bigger issue...it's a lottery system, capped annually.

That's EB-3, not H-1B.

Also, FYI, most categories are expected to be current or near current very soon. You picked a bad month to check as the fiscal year quotas are coming into effect. Check like 2 months back for what to expect for October.

Edit: Current = no wait fore the visa to become available (just processing timelines)

Since the H1B is not possible for her since she doesnt have any special skills. Could the EB3 work??

Theoretically

 

If she has an Employer to sponsor her, meets Perms requirements etc, not sure I have ever seen somebody sponsor a Au Pair for a GC but no doubt it has been done.

She needs to qualify for an EB-3 visa, part of which means finding an employer to sponsor her.

No wait time for a visa number to become available (or very short) is expected for EB-3 next month. Petition and visa processing times still apply. But those are typically measured in months, not years.
