AOS packet lost in mail (moved and merged)

I know you folks on VJ recently told me to relax and to be patient waiting on my NOA1 for the AOS. Again we sent it off on April 19th and it was signed for on April 23rd. However, I am noticing many people on here applied 2 to 3 weeks after my wife and I applied for the AOS and they have already received notifications. My question is , how can I find out what is going on with our application ? Our check has not been cashed as well.

Thank you in advance and I apologize for my repetitive inquiries.....

It’s been about 30 days - so you can call and inquire.  Perhaps there was an issue and they sent it back to be refilled, which can take time, but customer service should be able to see that.  In the unlikely event it is missing - they can guide you on that too.

Greetings !

A couple of weeks ago we inquired on VJ about our AOS status.  Well we called the USCIS last week and they told us it was rejected because of how the check was written out. The check was made out correctly however the amount was apparently written wrong in the area where you write it out below to where you Pay to the order too.

The problem is, we called again today because we have not received it back as it was mailed back on May 14th and no one knows where it is.

Our question is, even though we filed for this within the 90 days of my wife arriving here, can this cause problems until the RFE is sent back? We are out of that window now.

Thank you in advance

If your package was rejected, you will not receive an RFE.  You will get the entire package returned......I don't think you have technically filed until the NOA1 is issued.  Having said that, I think you have a valid explanation if needed.

Thank you so much. The lady that I spoke with encouraged us to wait at least 30 days to re-do the packet because if the other packet ever gets here, all we have to do is correct what is needed and send it back. If this is the case, we were told that we would not lose our "spot" or in other words it will keep the ball rolling.

I want to clear out something .I think you misunderstood the point. You just need  to get married within 90 days of your wife arriving here .It doesn't matter if you file ASO during that period of time or not. Also you got the receipt from UPS when you mailed it out that's a way you can track your package. Best luck !😊

They do create a receipt number even when entire package is rejected due to wrong fee. What I personally never figured out (and I am not willing to try myself "for science!"  :) ) is what happens when people resubmit it with correct fee if they reuse same receipt number, in which case "received/priority" date would stay the same as the lady implied to him, or do they create entire new case.

To the OP:

Not true....That is a very misleading statement.  Failure to file for adjustment of status before the expiration of the I-94 (90 days after arrival)  results in being out of status, and the person IS subject to detention and deportation......just recently, a poster failed to file for adjustment of status before expiration of her I-94.  She was passenger in a car which was stopped by the police.  As a result of her failing to file her I-485, she was jailed for 5 weeks.....and her case is still on-going........so, does it matter if you file for AOS during that period?  YES!
