Good morning,please am a Nigerian and my wife is a US citizen,we had marriage in Nigeria two months ago, she wants to file the petition for alien relative for me,while filing the questionnaire,is she gonna use my surname as her last name or she'll make use of her fathers name that she was using before we married as her lastname?

She should use her current legal name

That depends on if she legally changed her name... if she legally took your name then she would use your surname, if not, then she'd use her maiden name

 

To be honest, since she is the petitioner she should be on here asking the questions as she is the one who will fill out the paperwork.

Since we're having marriage certificate,is she gonna use her maiden name or my surname as her last name?because I heard marriage certificate is an evidence of change of lastname of my wife?

I filed K-1 and CR-1 myself by just read the instructions. I find USCIS instructions very easily to follow.

 

I came to VJ forum when I searched for some common interview questions and I had to sign-up as I found very interesting situations.

Well your wife, as the petitioner and USC, should be the one filling the forms since she is the one who is submitting the forms. 

 

Also, again, if she has had a legal name change in the US, then yes she uses your surname, if not then no, she uses her maiden name....

 

This is why it's important for the petitioner to be involved here on VJ, because sometimes there is a confusion and the information is misunderstood by the beneficiary.

It isn't legally required in the US to change a last name when married. Now if it's customary and expected in Nigeria for the woman to take the man's last name, then the embassy will question why she hasn't possibly... As for the I-130 petition, it won't be an issue.

They could to state they are aware of the relationship and all..... 

 

You should try using the search bar on top right corner of the page where you can search for specific topics and read other threads about it.

 

Also, up top left is a "Portals" tab, that will take you to the Nigeria forum where you'll find country specific threads and topics.
