Hi everybody!

So we're finally happily married ❤️

And we're back to the papers... I cannot believe we have to go trough this again. Anyway.. I have a lot of questions. I've read the entire thread and the instructions to fill up the 485 and I have some doubts. I'm sorry in advance if these are silly questions, but I want to make sure I send everything as complete an accurate as I can. I know that most of you are over this part but anyway, if you can give me some advice it will make a huge difference. 

 

- Form i-485:

A- Number: I remember filling this up on i-129 but I thought that is my husband's A number. Is this A number supossed to be mine? How can I know if I have one assigned?

 

- SSN: I don't have a SSN yet. In the state of MN you can get married without one so I waited for my marriage certificate to apply only once. The due date is October 29th so I guess that If I'm applying this week I will be fine. However, should I wait to have it to send my AOS or can I add a note stating that we're processing it ?

 

- Recent immigration history: Bullet 19 - noninnmigrant visa number for this passport : Is this the control number on the visa printed on my passport?

 

-Status on form i-94: Should I complete this with "k1 admitted" ?

 

- Current innmigration status?: same as the status of form i-94?

 

Part 2: bulleting 3 and 4. What's receipt number of underlying petition and date ? 

 

- Status on form i-94: Should I write in here "k1" ? my due date for i-94 is 10/9/2019.

 

Thanks again and I'm sorry. I'm completly rusty and bummed out that we started all over again with these forms.

It also says what the BC must have and mine has all of it. 

Luckily is a easy fix

This number is on your NOA2.  If you look above the beneficiary's name (third box down on the right-hand side), there will be a number that starts with an A.

I believe part of the AOS (somewhere on the form) it asks you if you want the SSA to issue a SSN, so you may not even need to go and get that but have it be part of the i-485 form.  @andreaam  might have more insight on that.  Or, you can always just apply at the SSA, but I don't know how you would let them know you are processing the SSN in your AOS application.  Additionally, there is no "limit" to filing the AOS.  Now that you are married, you can wait for the SSN to then submit the AOS, so the "due date" of October 29th is no longer relevant because you are married.  It would be a matter of you wanting to wait or not and knowing that it can prolong everything if you do.  It takes about 4 weeks to get SSN.  If you were to do it this week, you can get the SSN in time to submit the AOS prior to October 29th.

This is the red number on your visa (the one stapled to your passport) that starts with a P, it should be underneath the expiration date of the visa.

Status should be the K1 - Alian Fiance (e) of USC option.

Yes, that's what we did.  We put K1 - Alian Fiance (e) of USC.  Of course were married already, but just to keep things the same.  You will have a copye of your marriage anyways, so they will know you are married, even if you choose to keep it as K1 fiancee, etc.

This is your normal WAC number, the one listed on everything.  Chances are you do not have a priority date (unless there is one listed on the NOA1 or NOA2 of your K1).

Same answer you use on the ones listed above.

Did you get a RFE through other means?  If so, who prompted you to wait on the official hard copy?  If you have a RFE, you should respond to it ASAP so there is no delay.  You could include a letter in front of it saying this was a response to a RFE and use your petition number and information as reference.  Likewise, you can include a copy of the RFE (whatever form).  Hope that helps!

Update:  For those of you that will be filing the AOS AFTER the October 15th, 2019.  Please read through this page as the I-864 seems to be more intrusive.  Although I did not review it, I read in another thread that the new one asks for credit card debt and credit score.  Just a nugget of knowledge if you need to start thinking about potential co-sponsors or whatever.

Yes, that's what we did.  We put K1 - Alian Fiance (e) of USC.  Of course were married already, but just to keep things the same.  You will have a copye of your marriage anyways, so they will know you are married, even if you choose to keep it as K1 fiancee, etc.

I'll add on your response of the SSN. We filed for ssn after we married and before filing AOS. The work permit form I believe has the option that let's you tell them that you want a SSN to go along with the filing. We put yes and in the sheet of additional information made a note that we had filed it already.

 

My wife did get her ssn in the mail and there was no problem.

 

Regarding the alien number, I actually didn't realize there is one in the noa2 of the k1. I wonder if it's going to be a problem since we didn't write her alien number on the 485 form.

Also you shouldn't have an alien number yet since you are now filing for it in form 485. On this form the beneficiary is the person filing , not the petitioner. Once you get your noa1 for both aos and EAD you will have an alien number assigned in the notice. Im pretty sure that's how it is but I could be wrong.

Thank you for answering the SSN information I couldn't, since I went about it differently.  I did recall seeing the option of requesting for the SSN to get issued or state it is being done if you don't already have it.

 

Now, the reason why I told her to do the A number listed on the NOA2 is because this is what we did.  That A number on top of the beneficiary belongs to the beneficiary not the petitioner.  Thus, it applies for filing the form 485.  I found this information out from my personal research and through Rapid Visa.  I don't know that leaving it blank or using the NOA2 A number would be a huge deal either way.  But, I thought, since I had the number and the research confirmed it, why not include it?

Right.  It is a number, so, as I said, even if they do issue a RFE, it would be easily fixed.  In comparison to what we have gone through (medical exams in USA on top of paperwork), re-submitting a number would be easy! :D
