Hi I just received a letter from USCIS Today it’s form I-797C saying they received the petition.Is this NOA1?Thank you

Hi,

 

Im(naturalized last year) planning to apply the GC for my mom(my father deceased). I have a couple of questions.

 

1) my mom is a housewife and unemployed. Does it make any negative impact since consuler officers may think she’ll apply for unemployment benefits once becoming a permanent resident ?

 

2) my mom doesn’t have considerable money in her bank account(I as the son is the 100% sponser). Will it make any negative impact?

 

3) When i go through ir5 trackers and immigration forums, i can see that time takes for processing ir5 is roughly 11-14 months. Is it correct and does it depend on the country of residence of my mom ?

 

4) Online I saw multiple document checklists. For instance according to the uscis website only the i130, naturalisation certificate and petitioner’s birth certificate needs to be submitted while some friends in visajoirney had posted that they submitted copies of mom’s passport, mom’s birth certificate, marriage certificate of my mom and dad in addition to i130, pettitioner’s birth certificate and naturalization certicate. What is the document checklist that needs to be submitted along with i130 as of now?

Questions 1 & 2 does not affect your filing. It’s about you or joint supporter being able to support your mom. Immigration uses the poverty guideline for that. 

 

Question 3- the tracker is a guideline based on where they’re at with processing  

 

question 4- you need the documents on the list. Submit everything required or your petition will be held for those evidences

Hi guys,

This is my update on my mom’s process. Yesterday, I received an RFE for her medical to be submitted by July 25th. She’ll be doing her medical today. As per USCIS parents and minors are normally exempted from interviews. My mom is in the US. A previous letter from USCIS mentioned that if there’s an interview they will schedule it and inform us to take the I-693 with us. If no interview is required, they will send an REF with the address for it to be submitted and then mail her Green Card. I got the latter, thus no interview. Will keep you posted regarding her timeline.

Timeline

Hello filed for my mum in March, 2019 and I got an RFE for late registration of birth certifcate. Secondary documents were requested. However, I could only get school records. Even with that The school could only write a letter showing the name of my parent, my date of birth, place of birth and house address they had on file when I was a student. They also gave me a copy of my certificate of completion they had on file.

 

I had my uncle and aunt write affidavits confirming the relationship with my mum. I also opted for a DNA Test through the USCIS recommended lab.

 

Will these documents be sufficient to prove the relationship between my mum and I?

 

PS: I did not include baptismal or medical records as we lost those documents in a flood. And the clinic I was born is no longer operating.

@kcoyclay1 can you share more about the no need for interview letter you got? Was that from your local FO or was that from the (regional) service center? I also filed an I-485 AOS for my mom (from B2 tourist which I'm assuming is also what you did for your mom) and her I-485 status is showing awaiting appointment by local field office. I'm wondering if the no interview letter you got is because your mother is elderly unlike mine who is under 60? 

 

I was hoping that she would not need an interview in person as our I-485 package had all our necessary tax transcripts as well as the medicals already. My concern revolves around how long we would have to wait due to the I-485 interview backlog.
