Tax transcripts with or without W2

Hello,

 

My wife (USC) is sponsoring my spouse visa. We have passed the USCIS stage (thank God) and are now waiting for our NVC case number.

My wife filed her taxes but didn't pay anything thanks to the foreign earned income exclusion.

We will be using her step-dad as co-sponsor.

 

I have a few doubts/questions:

- is it okay if I just submit my wife's tax transcripts mailed by the IRS and her step dad's tax transcripts as he will be the co-sponsor?

- Will we have to also submit W2s if we use the tax transcripts? Or that's only if we were to submit tax returns? My wife doesn't have any W2s anyway as she works abroad and declared $0 on her return (Again, because of the foreign earned income exclusion.)

If you have the transcripts from the IRS just send those.  I have seen a couple of threads where people sent both the transcripts and W2s and then received an RFE since they didn't also include personal copies of the returns.

As said, W2 isn’t required if sending return transcript.

Your wife can just use tax transcripts.

The joint sponsor can use a tax transcript as well, but remember that he needs needs to provide evidence of current income as well (i.e. pay stubs & employment letter).

From the instructions:

 

If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income.

 

So if the step dad filed a joint return he will need to send his W2s along with the transcript, unless his spouse will be signing on as well.
