Here's a good sample letter I found in another thread. 

 

Good starting point for you for ideas and template for a letter...

K1 Visa:

I assume by the smiley, that was a long time ago? :) If she is still registered to vote in the U.S. even that would help a tiny bit.

Just now we were able to get my fiancé employment letter and bank statements only and still looking for vote registration i hope we will get that too... 

do you think these things enough? I don’t think so more than this we can provide🙁

Domicile proof:

 

An address 

A current drivers license

A registered / insured vehicle

Assets - like a bank account (done)

Filed taxes

Credit cards

A US phone (vonage, mobile)

 

All tied to that address

 

These things are good to get set up before, not after, the petitioner files

 

Voting never came up with us.

She should have filed taxes even if no tax payment was due.

 

She should have a DL by now.

 

Did she use this address as a mailing address while living abroad?

 

Does she have a job?    There should be a number of documents from her employer that help prove income as well.

This... if she hasn't filed taxes, she will have to regularize her situation with the IRS too. 

 

If you are at the interview stage, how did the domicile come about? Did they make a formal request?

Bizarre. I (US Citizen) was also living abroad with my then-fiance when we filed for his K-1. I just used my parent's address on all the documents that we submitted. I was never asked to prove that that was my domicile, but when we went to his K-1 interview they asked me several questions about what I was going to do when we got to the U.S. and where we would live. There is no requirement for the K-1 that the USC be living in the USA at the time the petition is filed... It actually can show a more genuine / "proovable" relationship that she has been living with you in China, if you ask me. 

 

Potentially just submit a signed affidavit from the USC stating they she will live with her parents when she returns and you will live with her? Could also have an affidavit from her parents saying as much. This wouldn't mean that you couldn't move out immediately after as soon as you two find your own place.

Timeline

An important question for OP is the affidavit of support, which requires supporting documents like tax returns for the US citizen petitioner.  US citizens are required to file tax returns regardless of where they live, reporting (and paying taxes if necessary) on their world-wide income.  This could come up at the interview, so be ready with documents and answers.

You need to include information on how you will be moving back to the U.S..... draft up a rental agreement with her parents showing your address and terms. Explain your situation. You can't just send in things that make it look like she lives in the U.S. when they know she doesn't. Read the instructions on the I-864 (Item #5), you would fall under #2 and #3 of that. If you don't have enough evidence to fulfill #2, then you need to follow #3 and prove in good faith you are returning to the U.S. This is the stage (AOS) when the domicile part will be required, your consulate interview is making sure she will be able to sponsor you at this stage, the I-134 is basically a pre/formality version of I-864 when it comes down to it. All your tips and tricks are in that. What you have now may be enough but they also may not be, why risk it?

OP has already had his interview. He is in AP with a 221g for more info on USC domicile, and looks like also a police certificate.

That’s more than enough.  The list I provided was our list for (successfully) proving intent to domicile last year and yours should be more than adequate.  I was using my brother’s address at the time but told then at the interview we would lease something after the visa is approved and in-hand.  Best of luck to you.
