Divorce, married, birth certificates.

I am applying for an I-130 for my wife.  We have a previous denial on a Fiance visa.  I still have the certified Divorce, Marriage, and birth certificate documents from July 2012.  Can I still use these?  Has anyone tried this?  We know we need a new criminal background.

1.  Yes, you should be able to use those certified documents.

2.  Why was the K-1 denied?

Not really, but it can be overcome with quality evidence such as time spent together, financial co-mingling, and legal documents normally generated during a marriage.

A person who has the authority to speak and have special knowledge suggested that I get them re-certified here by a court or a notary but I just think that muddies the water for the interviewer.  First how would one certify something from China as being authentic.  Second why does the petitioner feel the need to certify the document again?  Is it fake?

 

The cost has increased to $62.00 per document at the law firm we are using in China from the $15.00 they used to charge.  With these three I am looking at five documents to be translated.

Then don't use this firm.  Documents from the Gong Zheng Chu (Notarial Office) do NOT expire.  You WILL need a new CURRENT police report.  Get the new one ONLY AFTER the I-130 petition is appproved.

I  go to China around 2 year interval for almost a month.  Been there 4 times so far.  We talk almost everyday on QQ or wechat.  Don't know about the co=mingle of finances.  I send monthly to make payments on our home.  Got 2 years left on it.  I tried to put her on my bank account but most of the banks in my city wont.  They require a tax id number of some kind and a signature on papers with her here to do it.  We have marriage documents and they are translated.

There's no expiration date on a certification, but I do know of cases (outside of immigration law) where people squawk a bit if a notary or certification is greater than a year old.  

 

Is having a fresh certification a good idea?  Sure, never hurts.  But, I don't think it's absolutely necessary.

The above amounts to irrelevant nonsense.  We ARE talking about US Immigration here.  Police reports must be fresh if from the country of current residence.  Otherwise, a certified copy of a document is good forever.  (A couple strange exceptions like birth certificates in Ghana, but this is about CHINA.)
