It's the I-129F that you need to file, I-129 is a form filed by employers for non-immigrant workers.

Thank you for the correction.

Quick question concerning home address and employment history.

Looking at section "Your beneficiary's address"  12a. through 13b. If she has lived at the same address for over 5 years, and still lives there, what should be put for Date to? (13b)

Also, its the same address as her mailing address, so do i still need to fill it out?

Also, for employement, she has had the same job for over 5 years, and still works there.  How do i put an end date for things that are still being utilized?

If still currently living there/in that job position put 'present'

As for the same address as mailing address, I put the address in again to be safe.

I just talked with a lawyer and he recommended that we get married in China, and then start a marriage visa.

Given the complexity of the visitor Visa fraud, does this seem like a viable solution?

Also, if it is viable, would she still be able to come on visit on her tourist visa during the process?

How does the Lawyer intend addressing the Divorce Certificate.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Good God, being a lawyer myself I am sometimes wondering why on earth a professional person would give advice like they do. Being married with a history of visa fraud and not able to legally reunite with your spouse in the US is IMO, a worst possible background for applying for a tourist/visitor visa. Good thing is, denial of a new tourist/visitor visa after getting married is not likely to further spoil the spousal visa application. That said, for a couple in a situation as difficult as that and only having known each other for a short period of time recommending marriage is a very disputable advice, to say the least. IMO, by no means would actual marriage overcome the situation unless there is a strong legal evidence, ie successful court practice, that being married will make the waiver attempt successful whereas being merely engaged will not. And of course this previously married or not thing will not be resolved by getting married.

She has the visa she got by saying she was married.

What did the lawyer say when you told him about the previous "marriage" with no "divorce"?

She got the tourist visa through fraud making the CO believe she's eligible due to fake proof of ties with China. Now having a life focus in the USA how is it going to help?

Two issues with her visiting with her tourist visa:

1)  The visa was obtained through fraudulent methods.

2)  Higher possibility of her being denied admittance into the US with the pending CR-1, anyhow.

Pile up fraud on fraud. Or repeated coming to the US again on a visa gotten through fraud is OK and not aggravating the situation?

Sounds sort of aggravating to me.
