Sounds sort of aggravating to me.

Probably the existing tourist visa usage part was not the lawyer's idea but OP's interpretation

This.  This is what I would ultimately like to happen. None of the jumping through hoops trying to figure out what would work and won't work.

It feels like I should stay the course and just complete the I-129F and face the consequences as they come, without having to compound it any further.  I don't want to game the system.  I have no intentions of that. I am only asking or mentioning that which has been brought up to me.

We spent some time last night going over the application, and will continue again tonight as well.

It was a thought that crossed my mind while doing various searches and seeing the results being returned.  Had I thought it through before asking here, the conclusion I would have come to is that because it was obtained fraudulently, that it would be best to not utilize the tourist visa.

I'm curious----have you mentioned to her the possibility of you moving to live with her in China?

We have talked about that, and have also talked about moving to a country in Europe.  The problem with that is I share 50/50 custody and I won't move away from my kid.  That means at least 4 years of long distance relationship, which though not ideal, is doable. My fiancee is aware of that as well.

Well, if the lawyer is able to properly address the previous information on record with the CO...just be truthful from this point forward and let the chips fall where they may.  Wish you luck.

On what basis could she move to Europe?

Are their immigration laws more flexible?  She has a white collar job, so employment shouldn't be too difficult.

Probably depends which language she speaks.

Mandarin, with a little Japanese and some English.

For the time being, I'm going through the guides on this site and getting a check list together, as I'll be damned if it's going to fail because of something missing.

Unless she has a particular skill set in great demand does not seem Europe would be an obvious option.

nothing exceptional or out of the ordinary, just a good business sense. Thanks for that.  What would be an obvious option?
I've sent an email to the lawyer thanking him for his time, and my plan to go the K-1 route, and employ him when it comes time for a waiver to be filed.

I'm also checking with HR and what legal services they offer as well.

Thanks to everyone that has commented so far, I appreciate it, and hope to do some shoveling here in the future when i get more experience under my belt.

Obvious option would be marriage.

Not sure if you fully have read this thread.
