What Form an US citizen should apply to get permanent residence for the foreign parents who got in America with turism visa and they are still under legal status. ? thank you

The question is I dont want bring the parents. The parents are already living in USA ? I still need to fill out the I-130  or there is other form for parents living in US.

yes, the i130 is the first form, you need to submit the adjustment of status packet for each parent, which includes the i130

They cannot be LIVING in the US on tourist visas. I hope they are not working - even babysitting.

You cannot "live" on a tourist visa...you are a tourist who is just visiting.

According to OP they are "still under legal status" so less than 6 months. That said, I believe parents count as immediate relatives, so OP could file AOS for them even if they overstayed.

OP filed N-400 in April of this year. Are you a USC already then, OP? That's remarkably quick and will give hope to others going through the naturalization process. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Hello all,

 

Just some clarification on this post.

1 - Maybe i didnt communicate really well. The parents arrived in USA on turism visa. They are here just 1 week visiting the country, but the US citizen son was curios to know how to apply for permanent residence for his parents in case they decide to live here in the future. The US citizen son is searching the best away to maybe make this happen and have the family together.

2 - they are not working here, even babysitting.

3 - It was just a question to know more about applying for parents who already arrived in US on legal bases.

 

I really appreciate all comments and support.
