Timeline

Hi guys! I’m gonna apply for the N 400 this week.. a month earlier to my green card third anniversary.. the condition is not removed yet on my green card.. I got a second extension on my green card.. but I’m gonna go ahead and apply for the N 400.. I got two questions 

1- is it ok to apply for N 400 base on 3 years marriage without having the 10 years gc?

2-if I apply for N400 now, are they gonna work on my application or they will wait for 2 years condition to be removed before they start the process on my application 

Extra question, do you know any body got his citizenship while he still has the 2 years condition gc?

Extra question, do you know any body got his citizenship while he still has the 2 years condition gc? not possible, if for some reason your RoC is still pending at the time of your citizenship interview, you will have a dual interview for the RoC followed by citizenship, RoC must be adjudicated first

They get adjudicated together. Filing N400 generally forces them to get the RoC file and adjudicate it.

Filing N400 will stop processing on your ROC! If you can wait, I will suggest that you wait. This happened to me. My ROC was moved to NBC right after I applied for N400.

It will all depend on OP’s choice. If OP’s end goal is to be a U.S. citizen then filing the N 400 is a good idea especially now with record backlogged USCIS field offices nationwide. This gives OP a chance to jump start the process rather than wait many months to physically have ROC adjudicated before beginning. The only drawback is that ROC will leave processing and move to NBC to be adjudicated together with N 400. This isn’t necessary a problem as many offices now do joint I-751/N400 interviews together in same day. OP will just have to live without a physical green card until becoming a citizen but can still use I-551 stamps on passport as proof of permanent residency for employment and travel when necessary. I’m on my second I-551 stamp now since filing N 400 in December 2017 with a pending I-751.

Not true.  The ROC will be combined with the N400 and they will be adjudicated together.  That is why it was moved to NBC as when the N400 is filed, the service centers (California or Vermont) sends the ROC to the local office for combination with the N400 and this is done through NBC.  Btw, the ROC was not actually being processed at CSC or VSC, it was more than likely just sitting on a pile somewhere.  If a local office is working N400s a bit faster, then the applicant will most likely reach the goal sooner if naturalization is the goal.

 

To the OP, there is no need to wait for the ROC to file the N400, the processing clocks are independent and do not have to run in series.

Sure, I suppose there is that, but what do you tell a person that waits an additional 6-12 months for the ROC wondering if their file is next in line before they file for the N400.  If naturalization is the end goal, the ROC becomes a necessary evil, but is essentially meaningless.

RoC is taking forever anyways.
