11 Months under AP !!

Bonjour !
I applied for K1 Visa in US embassy in Paris to go marry my american fiancée in US, we lived together for over 2 years in Paris, and she left to work in USA from more than year during our visa process 
because we thought i would join her in 2-3 months.
Anyway, after the interview was placed under an administrative process  and get my passport because it may take a while, today it's almost a year that our case is on hold and all that I get from the embassy is emails asking me to wait, the last email to inform me that my medical exam was expired and i need to re-do it if they give me the visa later..
On may 2018 we got an answer from the immigration department in USA  - my fiancée called them by phone- that my file was closed and sent back to France, and that - everything looks good - ..but still, the US embassy says it's under AP till now.
Did anyone take that time to get an answer? is there any solution or at least anything to do about it? we are waiting from a year and you can't imagine how hard is it to put your life on hold for that long !!
P.S : i'm a Syrian citizen living in France for 6 years, and holding a french passport as a refugee, and have no criminal records at all...i never visited Syria or any banned country during the last 6 years.

The AP is clearly because of your Syrian citizenship. I don't think it matters where you live right now, just because of your citizenship you are probably under the current travel ban. If so, then your case will not get out of AP - and you'll need a waiver.

Hopefully other can help more. All I know those waivers are extremely rare.

There are a few who have been granted waivers, none I think who post on here so nothing muh to be done rather than wait.

With the recent SCOTUS ruling on the travel ban, it might be a wait for several years.

Someody the other day was trying to work out how long, too many variables, impossible to say. I agree it is likely to be longer whatever that adds up to.

@Léon H , it sounds like you are a dual citizen (see number 4 below) since you have a French passport.

 

Not sure if this is exactly your case, but you may want to look into that avenue more while you're looking for more info about waivers.

 

Exemptions and Exceptions

General Exemption

Under Proclamation 9645 Section 3(a), the entry ban generally applies only to nationals of subject countries who were outside the United States and without a valid U.S. visa on the applicable effective date of the Proclamation.

And so, individuals who meet either of the following conditions are exempt from this entry ban:

• Were inside the United States as of the applicable effective date; or
• Had a valid U.S. visa on the applicable effective date

General Exceptions

Under Proclamation Section 3(b), the entry ban also does not apply to:

1. Any lawful permanent resident of the United States;
2. Any foreign national who is admitted to or paroled into the United States on or after the applicable effective date of the Proclamation;
3. Any foreign national who has a document other than a visa, valid on the applicable effective date of the Proclamation, or issued on any date thereafter, that permits him or her to travel to the United States and seek entry or admission, such as advance parole;
4. Any dual national of a country designated under the order when traveling on a passport issued by a non-designated country;
5. Any applicant traveling on an A-1, A-2, NATO-1 through NATO-6 visa, C-2 for travel to the United Nations, G-1, G-2, G-3, or G-4 visa, or a diplomatic-type visa of any classification;
6. Any foreign national who has been granted asylum;
7. Any refugee who has already been admitted to the United States;
8. Any individual who has been granted withholding of removal, advance parole, or protection under the Convention Against Torture

An individual who fits into any one of these categories should not be subject to the 2(e) travel ban.

You said you have a french passport, so to the best of my knowledge you should not be subject to the travel ban. Dual citizens are exempt.

Actually im not holding 2 citizens, but i'm holding only Syrian citizen, in France, I get my refugee status after i finished my study, and here they give you as refugee a French travel document _ aka passport_ to use it because you can't use the syrian passport anymore ,so i'm Syrian, using french passport for refugee.

I dont have a french passport, it's a passport giving by french government for refugees,  which mean i have my bio print in the french administration, but im not french
