Hi, 

 

When I move on a CR1 to the US does that automatically trigger my green card application? I have an opportunity to transfer in my current job so my boss is looking for me to confirm. Or do I need to apply for a green card much like if I'd moved on a K1 Visa?

 

I'm confused!!

When you enter the US with your CR1 visa, once the immigration officer admits you, you are a legal permanent resident. It is NOT like a K1. K1 is a non-immigrant visa.

As long as you have paid the fee then the card will be sent to you. Some people pay before they enter the US so that when they enter the card will automatically be sent out.

Ah OK, so at what is the earliest point I can pay this? I'd rather do this before I emigrate.

I have seen people pay 1-2 weeks before entry. They will then receive the card within 4 weeks of entry to the USA.

Not necessarily.  can still be a fickle process on the USCIS end .. took a few weeks for my husbands and 6 months for mine... but I gad my stamped visa so it’s delay wasn’t a big issue.. 

6 months to get your GC after entry?????????? When did you pay for the green card, before or after entry????? Damn, I would be so mad if that was me... My wife came on the K1 so I did not go through the CR/IR-1 process myself but I am going off what I have seen here on VJ.

At the NVC stage you'll have the AOS fee of $120 and the IV fee of $325, then the medical in the UK is £290, and then the green card fee which I believe is $220

USCIS is still USCIS...  not sure if my file was lost, assigned to a slow or absent agent, problems with fingerprints taken at POE.. given the usual weird inconsistent answers during the waiting time. It amazingly appeared 1 week after the Congressional representative made an enquirer on my behalf 

We had a guy in one of the Swedish-American groups on Facebook who received his conditional greencard one month before he was due to file for ROC. So yeah, USCIS do screw things up sometimes

Mine took 5 months after I entered and I paid 2 days before I entered the US. No clue what held it up because everyone else in the thread I was following at the time got theirs pretty quick!

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I haven't seen the physical green card take less than 3 weeks since they started charging for it.  But I have seen it take up to 8-10 months.  Right before ROC would be extreme! After 5-6 months you should go to a representative to ask what is going on as a poster here did.  

You dont HAVE to pay before arrival and I've seen the card come within 2 weeks of payment when payment was made 2 months after arriving.  Most people pay ahead though.

 

OP please read our guides.  It sounds like you're only on the USCIS portion and have only filed the I-130 currently?  I have not yet read your timeline or looked at your profile. But it's best to prepare for all the stages before they happen is quickness is what you want.

As mentioned though, your immigrant visa becomes a temporary green card valid for 1 year upon endorsement.  So when you enter, and the CBP officer at POE stamps the visa, it becomes a green card for all intents and purposes. You can use it as proof of your work validity. You can't get paid until you have an SSN but you can work.
