Maiden vs married name

Hello to all,

 

If petitioner is a woman(who takes on her husband's last name) does she file with her maiden name or married name on behalf of her husband(the beneficiary)? CR-1 visa.

Whatever is her legal name. If she legally changed it then she needs to use that.

I didn't legally change my last name until my husband arrived in America. So everything was filed under my maiden name....they didn't even question it.

I’m not sure about other countries but as I registered my marriage in USA-California, my marriage certificate had my married name and my maiden name. I was informed that visa will be issued according to name on passport and green card based on name in visa. Thus, to get GC in married name, I need to officially change my name in my passport before getting my CR-1 visa. Which I’m processing in my country concurrently while my I-130 is being filed. I believe you can change your name once you enter USA but i’m Not sure about the procedure besides knowing that you need to apply for it somewhere. Maybe someone else can advise.

I filed my 1-130 with married name but included maiden name at the other name section as I think I can get my name changed in my passport before my I-130 will be approved.

File in the married name you intend to use going forward, whether you have "legally changed it" or not.  All a US Citizen does to legally change a name after marriage is show a copy of the marriage certificate at the Social Security Office and apply for a new card, then do the same at the DMV.  You are not required to do this prior to filing or at any given time.  You can change from Ms Jones to Mrs Smith, anytime you wish.  If the foreigner, the process varies but if you intend to use a married name going forward, get a passport in that name.
