Actually, you cannot use the beneficiary's income as supported proof that they will not become a public charge to the U.S. Only the USC financial income and/or any US sponsor will be used to determine if they meet the poverty requirement.

The beneficiary can bring their money over to help the USC provide support financially, but the I-134 and I-864 is specific to the USC or US sponsor. If they allow or used the beneficiary's source of wealth/income to help with determining the financially responsibility, there would be no need to have additional sponsors.

Keep in mind, whether its the K1, CR1, tourist/visitor, work or student visa - or any other type of visa, there is always a person, employer or agency that is being reviewed to determine that the beneficiary will not become a public charge while being in the US, whether it's for 3 months, 6 months, or until the beneficiary naturalizes. The beneficiary has to be the financial responsibility of some type of US government agency, be it a person, job, or university - until they return back to their country or immigrate and naturalize. Even after you marry your fiancé and they get a job - the USC is still the listed financial sponsor until naturalization. So, for example, if the USC & beneficiary divorce before the beneficiary goes home or becomes a US Citizen and they have to seek out public assistance (i.e., welfare), the USC will be responsible to pay for it.

Not saying that will happen, I'm just pointing out the importance of this part of the process because a lot of times people do not read pass what they see.

You actually can use it. Depends on the embassy but in Japan we can use our own savings as beneficiary.

Edit: hehe I didn't explain well, I meant I don't have to put it in his account or anything but to take my own bank statements as my proof :) I was surprised they would let me but then in japan people have so much in savings it felt normal.

Yes, you can self sponsor in the U.K. too, however it needs to be a lot, as stated by a previous poster.

It really also depends by who interviews you. I’ve read one who was from the U.K. and only had about 10k and was approved, but then a lady went with around £100k, and was told they wouldn’t accept it.

But it's not deciding factor. The USC must be able to provide substantiated proof that they will not let the beneficiary become a public charge. The beneficiary financial information plays secondary.

If that wasn't the case, then if the beneficiary does become a public charge the USC wouldn't be held liable to pay back any assistance given to the beneficiary since the beneficiary is claiming to be able to support and provide for themselves. And we all know the U.S. government is NOT gonna let that happen

ROC Filing:

4/21/2021 - Sent ROC Package via FedEx

4/22/2021 - FedEx package delivered and signed

5/11/2021 - Check cashed

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

6/9/2021 -  Biometrics waived - Case updated to Fingerprints taken

For AOS yes, but for the visa itself The petitioner can't be held possible anyways.. I-134 doesn't really have that power.

Everything is dependent on so many factors in this journey I can't follow, but yeah for Japan too self sponsoring is a natural way.. because to tell the truth having 50-60 k in a bank account is Really regular...

(I sometimes don't understand why we're moving to us and then I remember I hate working in japan....)

I am in the same position as you. I quit my job because I thought by now I would be over and my contract was ending. As long as your fiancé (the petitioner) meets the financial requirements you are okay to be unemployed. Same as you it has thankfully allowed me to travel a lot to the US, and the only difficulty I have faced is proving ties to the UK... many people use employment status for this! There really is no consequence of not having a job as the beneficiary.

Hi Im in the same position like u. I m unemployed since months because me and my fiance thought it will be approved by oct . We applied in june 6th. I refused two jobs offers in UAE because its 2 years full time contract. I stayed in Lebanon jobless because Im originally from Iraq not allowed to work in lebanon. Im kind of stuck because my lebanese residence visa will expire in Feb and Im no longer a student to ask for renewal. But being unemployed doesnt affect the petition as long as the other requirements are met.

Best of luck

I wish u hear good news before Christmas

Yeah - could be.  I've never seen a status in my scans that says "Address was updated", so this is probably the case.

@vocaledge done a few searches online regarding this... seems like some adjudicators use this as a way to notify the petitioner that their case is at least being worked on... it's one of the most confusing updates apparently because it really means nothing! I reckon it must be to do with our change of address, but seems odd that it's only being updated now, 4 months after we notified USCIS... maybe it's just not updated on the file until an adjudicator is actually assigned the case? WHO KNOWS... another baffling action by USCIS!

PS. THANK YOU FOR EVERYTHING!

i'm looking at the approvals coming for Brasil beneficiaries...and it's frustrating to see September and October applications being approved and my June 6 is still virgin.
