December 29th I believe.   I didn’t send it in until March 26th.  I waited until I  filed this year so I could take the tax hit on showing income to ensure I had plenty of room on this filing.

I did 2 years.   

 

The real issue for us is getting that AP.   They traveled to see a dying relative.   So we need that to bring them home before any potential interviews.

196 days and counting without EAD/AP.

 

We did receive an RFE for the AOS last week (that's already been submitted by us and received by them), but the RFE was simply requesting our most recent tax return information!  Well guess what, when we originally sent this packet to them in November 2017, the most recent tax information was included!  Because they waited so long to open our application, the most recent tax information had changed.  This is completely ridiculous!  We are contacting our congressman today.

 

My wife wants to give up at this point and just head back to Australia - and you know what, I'm with her.

Damn! I hear you :( six months going seven and counting! No RFEs (besides the initial I got on december), no letters, no emails, no updates, nothing. I haven’t heard of the Ombudsman in a month so it seems that’s a lost case too. My next step is contacting a Congressman but I can’t believe this.

Hi guys,

As it turns out. After having sent a response two weeks ago for a RFE to my I-485 application. My status changed this morning to 'ready to be schedule fro an interview'. That is a step and I am happy about it. Also, I am wondering WHERE IS MY EAD? haha

Do you know (from experience) if I should receive an EAD update soon?
And, should I contact my congressman again? Because I feel like a this point, if my file is complete and ok to get an interview, there is no reason for my EAD no to be approved soon.

I'm so sorry to hear that. We're closing into 150 days without EAD/AP and my wife is also getting very impatient. We haven't heard anything at all, no RFE, nothing. We tried expediting the AP on April 27 but we have yet to hear a yes or no; the only communication we got was an email saying "we're still reviewing your case" yesterday.

I'm in tears right now,finally my EAD has been approved after 212 days without rfie, we are adjusting status from K1. My case has also  changed from "we received you case" to we are "ready to schedule an interview ".my receipt date is nov 7 pd Oct 31st 2017 and my service center is NBC.l contacted the office of ombudsman to help look into my case on 7th of May 2018 they replied on 15th may that they have inquired why my case has taken too long and they would get back to me,since then l haven't heard from them.So l think it helps to contact ombudsman's office. I had raised close to 6 service requests and 1 requests to expendit ead unfortunately uscis sent me a mail saying that my case is under review and l will here from them shortly,this was back in March. I hope l get my interview appointment date soon.

I contacted the Ombudsman office five weeks ago, and a month ago they said the inquired my case with USCIS. Since then I haven't heard anything from them. Five weeks.

God I just took a look at the “timeline” on the USCIS for the AOS for my state 😫😱 going to 22 month!!! It have desperate me more than ever. I just hope for all of us that things are going to begin to move a little bit.

If you're talking about 22 months being the higher end of the range they give, I wouldn't worry too much about it.  It would seem that the majority of cases are completed within the earlier of the two numbers they give, with the more difficult cases taking up to the second number.  Stay optimistic that your case will wrap up on the lower end!

I contacted ombudsman and sent evidence of financial hardship (unpaid bill)l also have uncleared student loan back in my home country..so l sent evidence of that too.did you send anything  to support your request to have your case looked into?

After 197 days, I woke up this morning to a notification that my I-765 (EAD) is being produced!!! I'm so relieved.

I haven't had a notification about AP, although I applied for both together. Am I right in assuming that this too has been approved and I'll receive the combo card? I'm due to travel back to the UK in under 3 weeks and have been having sleepless nights for the last 4 weeks stressing over this!

 

A little background to my case. My NOA1 date was 22nd November. I received an RFIE 14th December for proof of birth (which was incredibly frustrating as I had already included my birth certificate when filing, but I sent my birth certificate again anyway). On 25th April I went for an Infopass appointment and was told I 'should have it in hand within 30 days'. 30 days later and I still hadn't heard anything, so I went back for another Infopass appointment. I was lucky as I saw the same officer again and he remembered me. There was no further update and I was stressing as I need to travel, so he called the office where my case was and explained the situation and asked if the person who had my case could look into it as soon as possible and make a decision. The person he spoke to on the phone said they'd email the officer who had my case but couldn't promise anything as it wasn't 'life or death'. The officer who helped me at my Infopass appointment took my contact details, and said he was going to check my case status everyday and give me a call by Friday this week if there had been no change to see if there was any news he could give me e.g. if he could see someone was working on my case. I'm not sure if his actions helped (as he had no way of knowing if the person he spoke to on the phone had even emailed the officer working on my case) but I'll forever be thankful to him for his help - he literally was the nicest guy (in comparison, the guy who greeted me at the desk when I checked in for my appointment was rude, and laughed in my face when I told him the USCIS website said that the current timings for EAD/AP were 3-5 months).

 

I'm keeping my fingers crossed for everyone still waiting. I know how frustrating it is when you see someone else has had theirs approved and although you're happy for them, it makes the wait even more tiresome. Believe me, I've been there. But hopefully the fact cases from November are getting their EAD/AP approved will give the rest who are still waiting hope that theirs is just around the corner :)

Hi everyone, looks like my AOS journey is completed now after coming over on K1 last August.

  • Married in October, honeymooned in Hawaii
  • Submitted AOS/EAD/AP application in November, took biometrics in December
  • EAD/AP Combo card was approved at the beginning of March
  • Mid-March - received a letter from the local office to provide the I-693 medical, strange as I submitted my vaccinations with my K1 application in July 2017
  • I went ahead to pay for the medical here and submitted back to the local field office in April
  • In mid May, received a letter from the local office for an interview in June
  • Attended the interview in June, received the Card is Being Produced notification later that day

Waiting for the EAD/AP was the hardest as I really wanted to get back to work. The interview came up earlier than expected so grateful we made it past this stage (even faster than the K1!). Waiting for the card in the mail and will be back in 2 years - 90 days for the ROC.

UPDATE on our case:

After 5 months of waiting I was able to contact Congressman's office. Either they actually helped a lot or it was a miracle that they looked into our case around the same time, 2 weeks after I reached them. We got RFIE in the end of March (SO LATE!) the letter didn't come, because there wasn't my name on my mail box. Finally thorough congressman office I received RFIE and was able to collect missing docs regarding Affidavit of Support. We sent the package last Saturday and I know National Benefit Center received it yesterday. 

 

Today is my 200 day since I applied for AOS! Fingers crossed that they will check my package and will receive essential EAD+AP docs really soon.... :-)
