I would appreciate if you can add or update your case status so that everyone can get an idea about field office progress in southern California.   2. My 2019-2020 FAFSA was flagged for verification at my university's financial aid office because I reported my spouse's income in 2017. I am the US citizen, and he did not pay US taxes in 2017, because he was not a resident alien, permanent resident, or a US citizen at the time, and did not make any income in the United States. He lived in Greece and paid taxes to the Greek government for the entire year of 2017, and was not liable to file taxes with the United States for 2017. We submitted his Greek tax form which shows his total income and taxes paid to the Greek authorities for 2017, and now they are requesting a 4506-T form from my spouse to prove he did not pay US taxes. We were married late 2018. Has anyone here gone through this? I am nervous about him signing anything stating he did not pay taxes because it doesn't quite encompass the truth, and do not want this being misconstrued by the IRS and have it come back to bite us. Any help would be much appreciated!

  6. Since, New Delhi US Embassy is no longer holding an interviews for spouses of USC & GCs. Bombay US Consulate is being busy with extra workload and applicants are facing longer waiting times even after case completion with NVC. Since Houston is one of the most slowest offices currently, it would benefit all of us to communicate and share any experiences we are going through when it comes to the AOS from a K1 visa in Houston. Please share any communications you have with Infopass associates or USCIS phone calls, and any other movement or changes with your case. Hello all, I'm hoping someone will be able to offer some advice, I've see a few posts on various forums about this particular matter but have yet to see an answer or definitive outcome to this situation. Some context about my case - For nearly two years I have been working on my O1 visa case with my lawyers; Kate Raynor & Associates. I have two job offers in Los Angeles waiting for me as a musician; one to join a band and the other to be an on call session guitarist to one of LA's top song writer/producers. We submitted my case with USCIS in June 2017 to which I was asked for more evidence. I was annoyed but did as requested and gathered more evidence then re-submitted at the end of October 2017. I then received a positive outcome mid December 2017 stating my O1 visa had been approved. I booked an appointment for my interview and to send off my passport to get stamped at the US embassy in London on January 3rd 2018. The interview didn't go as expected as I was told they would need to review my case further, the next day I received an email from the embassy with a 'notification of revocation'. The decision will now go back to USCIS who will either agree with the London embassy's recommendation to revoke my visa, or they might still think I deserve the O1 (I would think they would side with the embassy though). The average response time from USCIS seems to be about 6-12 months, possibly longer. As anyone can understand this is pretty ridiculous as no job offer will realistically wait indefinitely for an answer, even if it is positive, especially in the music industry. I have been given no specific reason as to why they are trying to revoke my visa other than one short line in the email saying 'The request for revocation is based on further administrative review of the applicant’s qualifications conducted subsequent to your visa interview at Embassy London.' This seems incredibly unreasonable as the interview only lasted about 5 minutes, I was asked about 5--10 questions which were somewhat vague, so I was unable to talk about 90% of the evidence that granted me the initial approval. It also appeared the consular officer who interviewed me had no previous knowledge of my case, so was basing the entirety of his decision on my answers in that moment. Does anyone have any knowledge/experience on how to resolve this matter quickly, ideally with the visa ultimately being approved? (as it has been approved in principal in the US). This decision will have massive long term ramifications on my life as, from now on, if I travel to any other country and they ask if I have ever been denied a visa, I will have to say yes and explain why. This will obviously count against me and will potentially impact my ability to work as, being a musician, I'm often required to travel all over the world for gigs. So the embassy's decision to refuse a visa to work in the US will now risk my ability to work anywhere else. It will also affect the band and producer who have offered me jobs as they will now have to start looking for other guitarists to fill my spot until this matter can be resolved, which again will affect their ability to work and progress.   9. 3 days ago I uploaded all of our AOS and civil documents. Today the NVC sent me a message saying I needed to upload my 2017 or 2018 tax transcript. I do not yet have the one for 2018. I uploaded my 1040 because I just got my taxes done on Monday and they told me I had to mail in instead of efile because my husband doesn't have an SSN. Why does the NVC say upload tax return OR transcript if all they will accept is the transcript?? I uploaded transcripts for 2016 and 2017 but IRS just received my return in the mail today so I imagine it will take days if not weeks for my 2018 transcript to be available to download from their site. This is so frustrating!! They accepted all of our civil documents. There was also an issue of my birth certificate being upside down but I've rotated it and resubmitted it. But what can I do about this 2018 tax transcript issue? Why aren't they accepting the 1040??
  10. Any 2017 divorce waiver filers have approval yet? Let’s track status and current updates on the case . I filed a joint petition in Nov 2017 at CSC and in Nov 2018 I converted it to a divorce waiver. Haven’t got any updates on my case yet.

Hi everyone We filed our I 751 very late and although I did find posts online pertaining to late filing, I didn't find many recent ones and not many instances where the OP updated how things turned out. I thought I'd add our experience and hopefully it might be of some help. We were supposed to file our I 751 in March 2016, but we ended up filing it in February 2017, almost a year later (and right after they increased the fee :P). Documents we sent in were IRS letter addressed to both of us 2 sworn affidavits Joint bank account statements Tax documents showing we filed jointly Family pictures Daughter's birth certificate Proof of 2nd pregnancy (sent in later, around November 2017) Hospital documents to support our reasons for late filing We attached a cover letter explaining our late filing, put our documents in a folder with each evidence separated by a colored, numbered tab,and put in a numbered index stating what the file contained. We received our NOA Feb 24, 2017, had our biometrics on March 23, 2017, but based on our address our appointment was in New York, and we were in Virginia around that time. I called up USCIS customer care and the agent was really helpful, asked me to walk in at the office in Virginia any time before the appointment date. We went the next day as our appointment was only a week away. Although they refused to accept walk ins as they were extremely busy, the guy there asked us to try again another day. We went the next day 20 minutes before the office opened up, waited and were the second people in line and they accommodated us. We had to go back again a month later (April 21, 2017) as apparently my fingerprints weren't clearly recorded, and we did the same thing, walked in early in the morning. We didn't receive anything after that, but in November we found out we were going to have another baby and sent in confirmation of the pregnancy as further proof of our relationship. It was a torturous and stressful wait, and we were highly stressed out mostly because of the dozen lawyers and posts online that stated that a year late I 751 is grounds for immediate denial. We consulted two lawyers before we filed and explained our situation to both. One of them was upfront and said your reasons are very routine reasons, nothing that is reasonable enough for a year delay, and in my opinion I don't think you have a good chance without a lawyer. The second one barely heard us out, just heard the basics, used the new presidency to intimidate us saying you will be removed from the country, separated from your children and kept asking how much we could pay. Started off quoting $8000 and his next quote was $4000. He actually made me want to do this on my own. I'm not giving out advice that people who file late don't need or shouldn't get a lawyer. It was a personal decision/risk that we decided to take. We signed up for the USCIS account, the DHS one, as well as the Case Status account but we only had the update ‘We have received your case’ with February 24th 2017 as the date (On the NOA it said February 17th 2017). FYI we noticed the Case Status account updated much later than the other account. March 6th, 2018 we received an email saying that they had taken action on our case, action being ‘We have corrected your name on your case.’ No idea what they meant by that, I checked the photocopies of the documents we sent in and we didn't make any mistakes with my name. Next update was March 7th stating ‘We have sent your case to your local office.’ I read on a few posts that they did this before an interview, we were pretty much prepared to give one considering how late we filed, so we were basically just waiting for the interview notice. We were extremely surprised and immensely relieved when on March 9th we received the update that they had approved our case. We received the approval letter a couple days later in the mail and in that they put down approval date as February 28, 2018. We didn't receive any further updates and on March 27, 2018, we received an email stating ‘We are still reviewing your case and there are no updates at this time.’ Although this worried us, we assumed they were just late in updating the status and it was probably an error. March 28, 2018 status changed to ‘We are producing your card.’ (On the case status account it updated to ‘We have started working on your case’ with March 25th, 2018 as the date which is bizarre as the other account shows that our case was approved on March 9th) April 3, 2018 Status changed to ‘We have mailed your card.’ with the date of action as April 2nd, 2018. We are signed up for Informed Delivery on USPS and were able to get the tracking number from there. For those who aren't signed up for Informed Delivery, you can either call USCIS or chat with a live representative through Emma (the virtual assistant on the USCIS website) and ask them for the tracking number. April 5, 2018 we received the green card The DHS account is much more reliable and updates faster than the Case Status one. I would recommend following that. Again, my post in no way offers any legal advice or recommendations. I simply want to share my experience as a late filer.
  12. Hello i have a question: december 22 my case was recieved and biometrics was on Jan 25th.. im still waiting while ive been seeing everyone get their work permit or a responce from uscis. My case number starts with MSC. Is anyone else on the same boat? I'm so sad because my husband wants to work😩 and travel to places but without anything he cant really do anything.
  13. My USC wife and I got married in good faith (arranged marriage) in Jan 2015 and I received my conditional GC in Jan 2016. I moved to the US on a student visa in 2010 and was on a work visa (H1B) when i got married. We jointly filed my i751 petition in nov 2017 to CSC. When i submitted the joint i751 i had included joint mortgage contracts, financial statements (credit and savings account), photos from marriage in US and India, vacations, family visits etc., air tickets, joint phone bills, joint car insurance, affidavits from friends and neighbors, my insurance showing her name as beneficiary, joint tax filing documents. We have been having issues since the last few months and have been going for counseling to see whether we can work it out. However, my wife let me know today that she'll be moving out next week back home (different state) and filing divorce right after that. Even after the counseling sessions, we couldn't reconcile our issues. The processing times at CSC is taking 18-20 months and my application was filed a little over 8 months ago. The last update I received was in May notifying biometric appointment is not required since they have past records and haven't seen any movement on my case since then. I'm not sure what the next steps are - some forums say no action is required until divorce is finalized, however others say to notify USCIS about the situation. In addition to evidences I had provided already I can also provide report from the counselor, 2017 joint tax, photos and itineraries from trips made in 2018, bank statements until next week etc. Any help will be highly appreciated. Also, is there a forum for i751 divorce waivers for 2017/2018 I can follow?
  14. Hello, Here is a quick synopsis of my story- I sincerely appreciate any help in advance! My wife and I were married in 2016- when I went to file my taxes in 2017 (FY2016), I wanted to file as Married Filing Jointly, but was unable to because at that point my wife did not have a SSN and the documentation need to get an ITIN was unattainable. I was forced to file Married Filing Seperately. She has now received her SSN and I had no trouble filing Married/Jointly in 2018 (FY2017) using her SSN. What I am trying to do is file an amended return for the 2016 tax year as Married Filing Jointly. Does anyone know what docs I need besides a 1040X? Any help/response received is appreciated! Thank you!
  15. I am currently trying to gather some information to figure out my options on bringing my spouse to the US. I am currently living in the US and my spouse is currently living in Europe as an Austrian Citizen(originally born in Croatia). I am obviously trying to minimize the time we spend apart during this process. During my research and advice that I received from others that the easiest way is to have my spouse fly to the US and we start the visa process from within the US. If started within the US, she would not be required to leave unless her application is denied. However, while searching online and on the USCIS website, it seems this is only possible on a K1 Fiance Visa and I cannot find any other supporting information on the USCIS website. I know that we will be filing for an IR1 Visa as we have now been married for two years. So sadly, I believe the K1 Fiance Visa will not apply anymore since we are married. So my questions are as follows: If my spouse flies to the US on an ESTA are we able to start the I-130 petition while she is here in the US and she can stay while the Visa process is taking place? If so, is still true for cases after 2017? Is there any other method of minimizing the time spent apart or is our only other option to start the process while she is outside the US? Thanks
