I'm an American-born US citizen, filing an I-130 and I-130A petition for my foreign-born wife as well as her daughter. My wife is here legally on a student visa application (under review), but her parents have both overstayed their visas by over a year. My father-in-law had a work visa/SSN and my mother-in-law was his dependent.

My question: When we give the required information about my in-laws on the I-130A, do we need to worry about triggering ICE "red flags" and risking their deportation?  We are especially wary in this new anti-immigrant environment.  Thanks!

Ding ding ding! Ya they always skip over the illegal part! I'd like to point out that the President's wife is an immigrant.

Just file your paperwork and your in - laws need to return home. They are illegal and yes, can be deported at any time.

CAN is the operative word, it's unlikely, but they can be if they get caught up in the shuffle.

The status if the legally immigrating spouse is not impacted by the illegal immigrant status of her parent.

One should never give misleading or false information to immigration.  Knowing doing so could have a horrible affect on your spouses approvals.  Her parents are adults and a responsible for their own immigration mess,

This will not be over quickly. You will not enjoy this.
