My cr1 visa do i need a waiver

I had an interview 2yrs ago but was denied based for presenting a fake traveling experience though i was denied under section 214b because that was the paper given to me by the consular officer. it is now in is record for lieing i guess if someone as done something wrong in the past he shouldnt lie about it. Now my question

1. From experience as anyone ever being granted visa even after lieing about such thing or no one can ever gets a visa without applying for a waiver if he lies
2. Do i need a waiver even to apply for an immigrant visa even though he i was denied based on 214b.

3. I have a cr1 nterview next week at the embassy should i just make up my mind that i will be denied 

4. If asked about the past misdeed what do you advise i should say

214(b) is for not having strong enough ties/immigrant intent. It's not for a misrep.

There is a question bordering my mind is it possible to be denied based on 212(a)(6)(C)(i) Material Misrepresentation / Fraud Material by a consular and handed a 214b slip after an interview because what i deserve is not 214b so what do you think is happening

What visa did you apply for two years ago? 

 

If they ask you about the misrepresentation tell the truth. Let them know why you lied at the time, if it was because you thought it would better your chances or you were given false advice by another person or whatever the case may be. Admit you learned your lesson that you should never lie.

I applied for a b2 visa planning to go visit my wife who was pregnant then but now am applying for a cr1 visa. But why wasnt i denied on 212c does it happen sometimes like that do i still have a chance or i should just start preparing to gile a waiver because truly i mosrepresented material fact with the fake travel history

It's extremely unclear honestly. It's really weird that they would tell you you're denied due to fake travel history but then only give you a 214(b) paper, which is nothing and not a big deal at all. Did they actually tell you to your face during the interview that you were denied because of fake travel history?

Yes the woman told me(you are advise to get a new passport because your agent got you a fake visa and this will affect your future relationship with the united states that was her statement) infact what i expected was the 212c i dont know if i should just start arranging money to file a waiver because this situation is so confusing

They only need to deny you for one reason, there could be a long list but only one is needed.

So should i just thank God i wasnt denied based on 212c but what if during the coming interview i am now denied based on the 212c that i was supposed to be given in the past is it possible?

Right now i am over prepared with genuine document for the cr1 visa and my marriage is real with reasonable evidence(kids).

They may have refused the visa under 214b, but that doesn't necessarily mean they didn't determine a finding of fraud either. All you can do now is apply for the visa and find out. Be sure to be truthful with all questions and documents moving forward - don't try to make anything "sync up" with a past lie.

Only one is needed, but if they do find multiple ineligibilities, they should/are required to inform the applicant about each of them.

 

OP:  It is possible that the officer did not deem your representation material to your application because it was so obvious tbat there was never an intention of issuing the visa and, therefore, did not add that ineligibility.  You will find out at the interview.

I have seen many cases where it seemed just one was used where it was reasonably clear many others were present.
