Another thing to add to your petition whether you file the K1 or CR1 is proof that you and your ex-wife were separated while you visited your new fiancee. I could see a CO questioning your relationship while the divorce was still pending, along with the other red flags that have been mentioned, notably the age difference and the fact that she has had seemingly little communication with your children, even if they are adults. 

 

I agree that the spousal visa is likely the best route for you, and it probably won't be an easy process, but as long as you address the red flags that you have already identified with solid proof of your relationship, the hurdles can be overcome.

It is what I believe I should have done....I am 4 months into waiting for my NOA2 for a k1 visa....I believe my k1 will take as much time as a CR1......and there are many more benifits to CR1.....

You get to work immediately from day one after entering the US on a CR-1. You don't have to apply to adjust status or apply for EAD/Advanced Parole, both of which cost money and take some months to process, not to mention additional paperwork and even an additional interview at times.

 

A CR-1 is an immigrant visa, which basically means you're automatically a permanent resident. With the K-1, this is not the case.
