Hi all,

I just joined the forum today because I am all over the place with the filing of the IR-1. First question is IR-1 and Cr-1 the same thing? I just got married on May 1st in India. I have known my husband since we were 12 (15 years now) and We have been together for like 3 years now. I moved to the US when I was 15. He moved to UAE (Dubai) 3 years ago. He is an Indian citizen. I am a US citizen. He has an Indian passport but he also has an Emirates ID since he resides in UAE.

>Where should I start with these papers? This is what I have so far- Form I-130, Form I-130 A, Form G-325 A (one for each of us), Form I-864 and Form G-1145. Copy of my US passport, copy of my naturalization certificate, copy of our marriage certificate from India, two passport size photos each, evidence of bonafide marriage (a joint bank account? and I will add him as a beneficiary to my TDA if I can) Do I submit all these to the Chicago Lockbox? ( I reside in NY) Is that all?

>When I fill out the I-130, should I put his permanent address as the one in UAE or the address in India (as that is the address on his passport)?

> I saw somewhere that his birth certificate (he was born in the UAE too and moved to India when he was 12 so we had translated his birth certificate using a size called daytranslations which is certified) is no longer needed with the I-130-is this true?

> I saw somewhere that I need a photocopy of all the pages of my passport along with the I-130 but in the I-130 instructions I saw I just need the biographic page?

>If I put his UAE address does that mean we could apply for the visa at the UAE consulate? Or do we HAVE to use the Indian consulate?

I hope someone can answer these questions for me as I am stressing out! I am still jet lagged, starting my masters program tomorrow and looking for a new place and working full time along with missing my husband like CRAZY ! I need HELP!!

Welcome to the forum.

You should give your titles more details.

Imagine if everyone just wrote IR-1.

It'll also help your post to get more traction.

They are not the same thing that's why they're named differently.

Much of the process is similar though.

Have you read the instructions?

You shouldn't be relying on this site as your main source of instructions for processing, forms/instructions change etc.

There are instructions on the official site. People here can definitely help but you need to make sure you're following the official instructions or you can risk delays to correct things.

IR1: If you two have been married for more than two years by the time your husband enters US on immigrant visa, it will be considered IR1 and he will get 10 year GC.

CR1: If you two have been married for less than two years when your husband enters US on immigrant visa, it will be considered CR1 and he will get 2 years conditional GC.

Yours will probably fall under CR1 since you just got married.

G32A is not needed at all. Form i-864 is not needed now, it will be required later on with NVC once USCIS sends your approved case to NVC.

For evidences of bonafide marriage, send as much as you can including proof of travel to meet each other, any communication correspondence, wedding and other photos, joint bank account if available)

Use the address of UAE since he is residing there.

His birth certificate is not needed during i-130, it will be needed during NVC phase.

Thank you so much for your answer! So basically Form I-130, Form I-130 A, Form G-1145. Copy of my US passport, copy of my naturalization certificate, copy of our marriage certificate from India, two passport size photos each, evidence of bonafide marriage-this should be my initial application packet along with a cover letter and table of contents? Does that sound right? Oh and the fees!

You only need a copy of your passport OR a copy of your naturalization certificate, not both.
