What does this mean for my case?

Timeline

Our case was denied in Feb 2017, then we filed for motion to reopen/reconsider on Feb 27 2017.

 

Then today I received the message noticed that my case I485 was reopened and it says I765 status is " My new card is being produced" but I485 status only shows "reopen the case"

 

So what does this mean our case for I485 will be approved or what does this I765 card being produced mean?

Timeline

It means your EAD was approved, based on your now-pending I-485 case. Once you receive the EAD card, you'll legally be able to seek employment. It is not a green card, as your I-485 is still pending.

thanks for your reply, but if EAD is approved, would that also mean I485 would be approved too? or is there a case that EAD is approved but not I485?

An EAD approval does nothing for the approval of an I-485. If your I-485 is eventually denied, your EAD is no longer valid, as the conditions of your EAD are only valid for as long as you have a pending I-485 case. Your I-485 is NOT approved at this time.

The EAD is only something you use while waiting for your greencard to be approved. So yes, the EAD is in most cases approved way before the actual greencard is, otherwise there would be no point with the EAD.

The above poster is correct.

You can have an EAD simply for having a case processing. Your case doesn't even have to be complete, as you can still receive RFE's for your green card and still get the EAD.  

In this case, your EAD was only approved because they reopened your case, but it has nothing to do with a green card approval, nor will it affect the green card approval if it happens.

The greencard can take anything between 3 and 12 months, in some cases even longer than a year.

 

You should have the EAD within 30 days from when your status changes to "new card is being produced". The next status is often "card was mailed to me", hopefully it doesn't take more than 2 weeks for you to receive the EAD card after that.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Yes there are people who have gotten ead and later on i485 was denied. They are two independent applications and approval of one does not mean the other will be approved. It is only at your interview or after your interview that you will know if your GC has been approved
